The amended label referred to above, submitted in connection with registration under the Federal
|
||||
Insecticide, Fungicide and Rodenticide Act, as amended, is acceptable. This approval does not
|
||||
affect any conditions that were previously imposed on this registration. You continue to be
|
||||
subject to existing conditions on your registration and any deadlines connected with them.
|
||||
|
||||
A stamped copy of your labeling is enclosed for your records. This labeling supersedes all
|
||||
previously accepted labeling. You must submit one copy of the final printed labeling before you
|
||||
release the product for shipment with the new labeling. In accordance with 40 CFR 152.130(c),
|
||||
you may distribute or sell this product under the previously approved labeling for 18 months
|
||||
from the date of this letter. After 18 months, you may only distribute or sell this product if it
|
||||
bears this new revised labeling or subsequently approved labeling. “To distribute or sell” is
|
||||
defined under FIFRA section 2(gg) and its implementing regulation at 40 CFR 152.3.
|
||||
|
||||
The alternate brand names “Relenya Fungicide Seed Treatment” and “Relenya Seed Treatment”
|
||||
have been added to the product record.
|
||||
|
||||
Should you wish to add/retain a reference to the company’s website on your label, then please be
|
||||
aware that the website becomes labeling under the Federal Insecticide Fungicide and Rodenticide
|
||||
Act and is subject to review by the Agency. If the website is false or misleading, the product
|
||||
would be misbranded and unlawful to sell or distribute under FIFRA section 12(a)(1)(E). 40
|
||||
CFR 156.10(a)(5) list examples of statements EPA may consider false or misleading. In addition,
|
||||
regardless of whether a website is referenced on your product’s label, claims made on the

website may not substantially differ from those claims approved through the registration process.

Hazards to Humans and Domestic Animals
|
||||
CAUTION. Harmful if swallowed. Avoid contact with skin,

mist. Causes moderate eye irritation. Remove and wash
|

|
||||

Applicators and other handlers must wear:

Follow the manufacturer’s instructions for cleaning and

Environmental Hazards
|
||||
This pesticide is toxic to fish and aquatic invertebrates. Drift
|
||||
and runoff may be hazardous to aquatic organisms in
|
||||
water adjacent to treated areas.
|
||||
DO NOT apply directly to water, or to areas where surface
|
||||
water is present, or to intertidal areas below the mean high
|
||||
water mark. DO NOT contaminate water when disposing
|
||||
of equipment washwater or rinsate.
|
||||
This product may impact surface water quality because of
|
||||
runoff of rainwater. This is especially true for poorly draining
|
||||
soils and soils with shallow groundwater.
|
||||
Groundwater Advisory
|
||||
This chemical has properties and characteristics associat-
|
||||
ed with chemicals detected in groundwater. This chemical
|
||||
may leach into groundwater if used in areas where soils are
|
||||
permeable, particularly where the water table is shallow.
|
||||
Surface Water Advisory
|
||||
This product is classified as having high potential for reach-
|
||||
ing aquatic sediment via runoff for several months or more
|
||||
after application. Poorly draining soils and soils with shal-
|
||||
low water tables are more prone to produce runoff that
|
||||
contains this product. A level, well-maintained vegetative
|
||||
buffer strip between areas to which this product is applied
|
||||
and surface water features such as ponds, streams, and
|
||||
springs will reduce the potential loading of this active ingre-
|
||||
dient or its degradates from runoff water and sediment.
|
||||
Runoff of this product will be reduced by avoiding applica-
|
||||
tion when rainfall is forecast to occur within 48 hours.
|
||||
Sound erosion control practices will reduce this product’s
|
||||
potential to reach aquatic sediment via runoff.
|
||||
USER SAFETY RECOMMENDATIONS
|
||||
Users should:
|
||||
• Wash hands thoroughly with soap and water after han-
|
||||
dling and before eating, drinking, chewing gum, using
|
||||
tobacco, or using the toilet.
|
||||
• Remove clothing/PPE immediately if pesticide gets
|
||||
inside. Then wash thoroughly and put on clean clothing.
|
||||
• Remove clothing/PPE immediately after handling this
|
||||
product. As soon as possible, wash thoroughly and
|
||||
change into clean clothing.
|
||||
FIRST AID
|
||||
If swallowed
|
||||
• Call a poison control center or doctor immediately for treatment advice.
|
||||
• Have person sip a glass of water if able to swallow.
|
||||
• DO NOT induce vomiting unless told to do so by a poison control center or doctor.

Directions For Use
|
||||
It is a violation of federal law to use this product in a man-
|
||||
ner inconsistent with its labeling. This labeling must be in
|
||||
the user’s possession during application. Read the entire
|
||||
Directions For Use and Conditions of Sale and
|
||||
Warranty before using this product.
|
||||
DO NOT apply this product in a way that will contact work-
|
||||
ers or other persons, either directly or through drift. Only
|
||||
protected handlers may be in the area during application.
|
||||
For any requirements specific to your state or tribe, consult
|
||||
the agency responsible for pesticide regulation.
|
||||
Relenya
|
||||
® fungicide is not for sale, distribution, or use in
|
||||
Nassau and Suffolk counties in New York State.
|
||||

||||
AGRICULTURAL USE REQUIREMENTS
|
||||
Use this product only in accordance with its labeling and
|
||||
with the Worker Protection Standard, 40 CFR Part 170.
|
||||
This standard contains requirements for the protection of
|
||||
agricultural workers on farms, forests, nurseries, and
|
||||
greenhouses, and handlers of agricultural pesticides. It
|
||||
contains requirements for training, decontamination, notifi-
|
||||
cation, and emergency assistance. It also contains
|
||||
specific instructions and exceptions pertaining to the
|
||||
statements on this label about personal protective equip-
|
||||
ment (PPE), restricted-entry interval, and notification to
|
||||
workers. The requirements in this box only apply to uses
|
||||
of this product that are covered by the Worker Protection
|
||||
Standard.
|
||||
DO NOT enter or allow worker entry into treated areas
|
||||
during the restricted-entry interval (REI) of 12 hours.
|
||||
PPE required for early entry to treated areas that is permit-
|
||||
ted under the Worker Protection Standard and that
|
||||
involves contact with anything that has been treated, such
|
||||
as plants, soil, or water, is:
|
||||
• Coveralls
|
||||
• Chemical-resistant gloves (made of any waterproof
|
||||
material)
|
||||
• Shoes plus socks
|
||||
STORAGE AND DISPOSAL
|
||||
DO NOT contaminate water, food, or feed by storage or
|
||||
disposal.
|
||||
Pesticide Storage
|
||||
Store in original containers only. Keep container closed
|
||||
when not in use. DO NOT store near food or feed.
|
||||
Pesticide Disposal
|
||||
Wastes resulting from using this product may be disposed
|
||||
of on-site or at an approved waste disposal facility. If
|
||||
these wastes cannot be disposed of according to label
|
||||
instructions, contact your State Pesticide or
|
||||
Environmental Control Agency, or the Hazardous Waste
|
||||
representatives at the nearest EPA Regional Office for
|
||||
guidance.
|
||||
Container Handling
|
||||
Nonrefillable Container. DO NOT reuse or refill this
|
||||
container. Triple rinse or pressure rinse container
|
||||
(or equivalent) promptly after emptying; then offer for recy-
|
||||
cling, if available, or reconditioning, if appropriate, or
|
||||
puncture and dispose of in a sanitary landfill, or by inciner-
|
||||
ation, or by other procedures approved by state and local
|
||||
authorities.
|
||||
Triple rinse containers small enough to shake
|
||||
(capacity
|
||||
/unif0a35 gallons) as follows: Empty the remaining
|
||||
contents into application equipment or a mix tank and
|
||||
drain for 10 seconds after the flow begins to drip. Fill the
|
||||
container 1/4 full with water and recap. Shake for 10 sec-
|
||||
onds. Pour rinsate into application equipment or a mix
|
||||
tank, or store rinsate for later use or disposal. Drain for
|
||||
10 seconds after the flow begins to drip. Repeat this pro-
|
||||
cedure two more times.
|
||||
Triple rinse containers too large to shake
|
||||
(capacity > 5 gallons) as follows: Empty the remaining
|
||||
contents into application equipment or a mix tank. Fill the
|
||||
container 1/4 full with water. Replace and tighten clo-
|
||||
sures. Tip container on its side and roll it back and forth,
|
||||
ensuring at least one complete revolution, for 30 seconds.
|
||||
Stand the container on its end and tip it back and forth
|
||||
several times. Turn the container over onto its other end
|
||||
and tip it back and forth several times. Empty the rinsate
|
||||
into application equipment or a mix tank, or store rinsate
|
||||
for later use or disposal. Repeat this procedure two more
|
||||
times.
|
||||
Pressure rinse as follows: Empty the remaining con-
|
||||
tents into application equipment or mix tank and continue
|
||||
to drain for 10 seconds after the flow begins to drip. Hold
|
||||
container upside down over application equipment or mix
|
||||
tank, or collect rinsate for later use or disposal. Insert
|
||||
pressure rinsing nozzle in the side of the container and
|
||||
rinse at about 40 PSI for at least 30 seconds. Drain for
|
||||
10 seconds after the flow begins to drip.

|
||||
earth, etc.) and transfer liquid and solid diking material to
|
||||
separate containers for disposal.
|
||||
• Remove contaminated clothing and wash affected skin
|
||||
areas with soap and water.
|
||||
• Wash clothing before reuse.
|
||||
• Keep the spill out of all sewers and open bodies of water.
|
||||
Product Information
|
||||
Relenya® fungicide is a broad- spectrum liquid seed treat-
|
||||
ment fungicide that protects specified seed and seedlings
|
||||
from certain seedborne and soilborne diseases.
|
||||
Refer to Detailed Use Directions for specific crop uses
|
||||
and diseases controlled or suppressed. Disease symptoms
|
||||
such as seed rot, seedling rot, seedling blight, root rot, and
|
||||
damping-off (preemergence or postemergence) can be
|
||||
associated with the actions of various fungal pathogens.
|
||||
Use the higher specified rates of Relenya
|
||||
® fungicide
|
||||
when disease is expected to be high.
|
||||
Mode of Action
|
||||
Mefentrifluconazole, the active ingredient in Relenya®
|
||||
fungicide, inhibits demethylation of sterol biosynthesis
|
||||
(DMI), which disrupts cell membrane synthesis and is
|
||||
classified by the Fungicide Resistance Action Committee
|
||||
(FRAC) as a Group 3 fungicide.
|
||||
Resistance Management
|
||||
For resistance management, Relenya® fungicide contains
|
||||
a Group 3 fungicide. Any fungal population may contain
|
||||
individuals naturally resistant to Relenya® fungicide and
|
||||
other Group 3 fungicides. A gradual or total loss of pest
|
||||
control may occur over time if these fungicides are used
|
||||
repeatedly in the same fields. Appropriate resistance-
|
||||
management strategies should be followed.
|
||||
To delay fungicide resistance, take one or more of
|
||||
the following steps:
|
||||
• Rotate the use of Relenya
|
||||
® fungicide or other Group 3
|
||||
fungicides within a growing season sequence with differ-
|
||||
ent groups that control the same pathogens.
|
||||
• Use tank mixtures with fungicides from a different group
|
||||
that are equally effective on the target pest when such
|
||||
use is permitted. Use at least the minimum application
|
||||
rate as labeled by the manufacturer.
|
||||
• Adopt an integrated disease management program for
|
||||
fungicide use that includes scouting, uses historical infor-
|
||||
mation related to pesticide use, and crop rotation, and
|
||||
which considers host plant resistance, impact of environ-
|
||||
mental conditions on disease development, disease
|
||||
thresholds, as well as cultural, biological and other chem-
|
||||
ical control practices.
|
||||
• Where possible, make use of predictive disease models
|
||||
to effectively time fungicide applications. Note that using
|
||||
predictive models alone is not sufficient to manage
|
||||
resistance.
|
||||
• Monitor treatment area for lack of biological efficacy that
|
||||
might indicate possible resistance development.
|
||||
• Contact your local extension specialist or certified crop
|
||||
advisor for any additional pesticide resistance-
|
||||
management and/or Integrated Pest Management
|
||||
(IPM) recommendations for specific crops and
|
||||
pathogens.
|
||||
• For further information or to report suspected resistance
|
||||
consult your local BASF representative, extension spe-
|
||||
cialist, or certified crop advisor.
|
||||

Container Handling (continued)
|
||||
Refillable Container. Refill this container with pesticide
|
||||
only. DO NOT reuse this container for any other purpose.
|
||||
Triple rinsing the container before final disposal is the
|
||||
responsibility of the person disposing of the container.
|
||||
Cleaning before refilling is the responsibility of the refiller.
|
||||
Triple rinse as follows: To clean the container before
|
||||
final disposal, empty the remaining contents from this
|
||||
container into application equipment or mix tank. Fill the
|
||||
container about 10% full with water. Agitate vigorously or
|
||||
recirculate water with the pump for 2 minutes. Pour or
|
||||
pump rinsate into application equipment or rinsate collec-
|
||||
tion system. Repeat this rinsing procedure two more
|
||||
times.
|
||||
When this container is empty, replace the cap and seal all
|
||||
openings that have been opened during use; return the
|
||||
container to the point of purchase or to a designated
|
||||
location. This container must only be refilled with a pesti-
|
||||
cide product. Prior to refilling, inspect carefully for damage
|
||||
such as cracks, punctures, abrasions, worn-out threads
|
||||
and closure devices. Check for leaks after refilling and
|
||||
before transport. DO NOT transport if this container is
|
||||
damaged or leaking. If the container is damaged, or leak-
|
||||
ing, or obsolete and not returned to the point of purchase
|
||||
or to a designated location, triple rinse emptied container
|
||||
and offer for recycling, if available, or dispose of container
|
||||
in compliance with state and local regulations.
|
||||
|
||||

Application Instructions
|
||||
• Use Relenya® fungicide in commercial seed treatment
|
||||
facilities and on-farm systems with commercial or profes-
|
||||
sional seed treatment application equipment only.
|
||||
• Restriction: DO NOT apply with planting application
|
||||
equipment (e.g. hopper box, planter box, slurry box, and
|
||||
on-farm seed treaters, etc.).
|
||||
• Use good quality, well-conditioned seed free of chaff.
|
||||
• Thorough and uniform seed coverage is required for opti-
|
||||
mum performance.
|
||||
• Mix only as much product as is needed for immediate
|
||||
application to seed. Apply at specified rates.
|
||||
• Apply the water-based mixture using standard slurry or
|
||||
mist-type seed treatment application equipment. Consult
|
||||
a seed treatment specialist about crop-specific slurry
|
||||
rates and seed treatment calibration and operation
|
||||
procedures.
|
||||
Use Restriction: When using formulations that do not
|
||||
contain dye, to comply with 40 CFR 153.155, all seed
|
||||
treated with a pesticide must be colored to distinguish and
|
||||
prevent subsequent inadvertent use as a food for man or
|
||||
feed for animals.
|
||||
The buyer of Relenya
|
||||
® fungicide is responsible for ensur-
|
||||
ing all seed treated with this product is adequately dyed
|
||||
with a suitable color to prevent accidental use as food for
|
||||
man or feed for animals. Refer to 21CFR, Part 2.25.
|
||||
Relenya
|
||||
® fungicide is not for sale, distribution, or use in
|
||||
Nassau and Suffolk counties in New York State.
|
||||
Tank Mixing Other Products
|
||||
When using Relenya® fungicide in tank mix with other
|
||||
seed treatment products, always follow the most restrictive
|
||||
label use directions.
|
||||
Compatibility Test
|
||||
Before mixing components, always perform a compatibility
|
||||
jar test.
|
||||
1. Add all intended seed treatment products and the
|
||||
appropriate amount of water in a clear glass jar.
|
||||
2. Mix well and allow to sit for one hour.
|
||||
3. Remix and observe for physical incompatibility.
|
||||
Also test with the seed to ensure the combination of tank
|
||||
mix products does not have detrimental effects on the
|
||||
seed.

Mixing Order
|
||||
Mechanical agitation is required to thoroughly mix
|
||||
Relenya
|
||||
® fungicide. Maintain agitation until the entire slur-
|
||||
ry mixture has been used.
|
||||
1. Water - To a thoroughly clean mix tank, add 3/4 the
|
||||
required water volume and begin agitation.
|
||||
2. Dye or colorant
|
||||
3. Wettable powders
|
||||
4. Soluble powders
|
||||
5. Flowable formulations (such as Relenya® fungicide)
|
||||
- Containers 5 gallons or less: Shake well before
|
||||
adding to the tank.
|
||||
- Containers more than 5 gallons: Recirculate
|
||||
before adding to the tank.
|
||||
- Consult a BASF representative for additional informa-
|
||||
tion regarding agitation and recirculation.
|
||||
6. Emulsifiable concentrates
|
||||
7. Remaining quantity of water (can be used as rinsate
|
||||
for the chemical container or to adjust total slurry to
|
||||
compensate for water displacement by powdered
|
||||
products)
|
||||
8. It is the pesticide user’s responsibility to ensure that all
|
||||
products are registered for the intended use. Read and
|
||||
follow the applicable restrictions and limitations and
|
||||
directions for use on all product labels involved in tank
|
||||
mixing. Users must follow the most restrictive directions
|
||||
for use and precautionary statements of each product in
|
||||
the tank mixture.
|

Labeled Crops
|
||||
• Use higher specified rates when disease pressure is expected to be high.
|
||||
• DO NOT use treated seed for food, feed, or oil production.
|
||||
• DO NOT store Relenya® fungicide near food and feedstuffs.
|
||||
• DO NOT contaminate feed or foodstuffs.
|
||||
• DO NOT contaminate domestic or irrigation waters.
|
||||
• DO NOT plant crops within 30 days after planting Relenya® fungicide-treated seed.
|
||||
• DO NOT use the same auger or seed treatment equipment for treating seed that will handle commercial or feed
|
||||
grains unless these have been thoroughly cleaned.
|
||||
• DO NOT store leftover treated seed where there is a chance of it becoming mixed with untreated seed. Store treated
|
||||
seed in cool, dry conditions.
|
||||

||||
SEED BAG LABEL REQUIREMENTS
|
||||
The Federal Seed Act requires that containers containing
|
||||
treated seeds shall be labeled with the following
|
||||
statements:
|
||||
• This seed has been treated with Relenya
|
||||
® fungicide
|
||||
containing mefentrifluconazole. DO NOT use treated
|
||||
seed for food, feed or oil purposes.
|
||||
The U.S. Environmental Protection Agency requires the
|
||||
following statements on containers containing seed treat-
|
||||
ed with mefentrifluconazole:
|
||||
• Store treated seed away from food and feedstuffs.
|
||||
• DO NOT allow children, pets or livestock to have
|
||||
access to treated seed.
|
||||
• When opening this bag or handling (e.g. loading, pour-
|
||||
ing) treated seed wear:
|
||||
- Long pants and long-sleeved shirt
|
||||
- Shoes and socks
|
||||
- Chemical-resistant gloves made of any waterproof
|
||||
material
|
||||
• Treated seed exposed on soil surfaces may be haz-
|
||||
ardous to wildlife.
|
||||
- Cover or collect spillage during loading and planting, in
|
||||
particular at row ends and field corners.
|
||||
- Dispose of excess by burying away from bodies of
|
||||
water.
|
||||
• DO NOT contaminate bodies of water when disposing
|
||||
of planting equipment washwater.
|
||||
• Dispose of seed packaging in accordance with local
|
||||
requirements.
|
||||
• Excess treated seed may be used for ethanol produc-
|
||||
tion only if:
|
||||
- By-products are not used for livestock feed.
|
||||
- No measurable residues of pesticide remain in ethanol
|
||||
by-products that are used in agronomic practice.
|
||||
• Plant into the soil to at least the minimum depth to mini-
|
||||
mize exposure.
|
||||
• DO NOT enter or allow worker entry into areas with
|
||||
treated seeds during the restricted-entry interval (REI) of
|
||||
12 hours, with the exception that workers may enter if
|
||||
they will have no contact with the soil/media subsurface.
|

• DO NOT plant crops within 30 days after planting

The Directions For Use of this product reflect the opin-
|
||||
ion of experts based on field use and tests. The directions
|
||||
are believed to be reliable and must be followed carefully.
|
||||
However, it is impossible to eliminate all risks inherently
|
||||
associated with the use of this product. Crop injury, inef-
|
||||
fectiveness or other unintended consequences may result
|
||||
because of such factors as the presence of other or
|
||||
untested or unapproved materials, seed of low quality or
|
||||
low vigor or low germination, use of the product in a man-
|
||||
ner inconsistent with its labeling, misapplication of the
|
||||
product, or weather conditions at planting or environmen-
|
||||
tal conditions during seed storage, all of which are
|
||||
beyond the control of BASF CORPORATION (“BASF”) or
|
||||
the Seller. To the extent consistent with applicable law, all
|
||||
such risks shall be assumed by the Buyer.

BASF warrants that this product conforms to the chemical
|
||||
description on the label and is reasonably fit for the pur-
|
||||
poses referred to in the Directions For Use, subject to
|
||||
the inherent risks, referred to above.
|
||||
TO THE EXTENT CONSISTENT WITH APPLICABLE

||||
LAW, BASF MAKES NO OTHER EXPRESS OR
|
||||
IMPLIED WARRANTY OF FITNESS OR MER-
|
||||
CHANTABILITY OR ANY OTHER EXPRESS OR

IMPLIED WARRANTY.

TO THE EXTENT CONSISTENT WITH APPLICABLE

LAW, BUYER’S EXCLUSIVE REMEDY AND BASF’S

ERWISE, SHALL BE LIMITED TO REPAYMENT OF
