The amended labeling referred to above, submitted in connection with registration under the Federal
|
||||
Insecticide, Fungicide, and Rodenticide Act, as amended, is acceptable.
|
||||
This approval does not affect any terms or conditions that were previously imposed on this registration. You
|
||||
continue to be subject to existing terms or conditions on your registration and any deadlines connected with
|
||||
them.
|
||||
A stamped copy of your labeling is enclosed for your records. This labeling supersedes all previously
|
||||
accepted labeling. You must submit one (1) copy of the final printed labeling before you release this product
|
||||
for shipment with the new labeling. In accordance with 40 CFR § 152.130(c), you may distribute or sell this
|
||||
product under the previously approved labeling for 18 months from the date of this letter. After 18 months, you
|
||||
may only distribute or sell this product if it bears this new revised labeling or subsequently approved labeling.
|
||||
“To distribute or sell” is defined under FIFRA section 2(gg) and its implementing regulation at 40 CFR § 152.3.
|
||||
Should you wish to add/retain a reference to your company’s website on your label, then please be aware that
|
||||
the website becomes labeling under FIFRA and is subject to review by EPA. If the website is false or
|
||||
misleading, the product will be considered to be misbranded and sale or distribution of the product is unlawful
|
||||
under FIFRA section 12(a)(1)(E). 40 CFR § 156.10(a)(5) lists examples of statements the EPA may consider
|
||||
false or misleading. In addition, regardless of whether a website is referenced on your product’s label, claims
|
||||
made on the website may not substantially differ from those claims approved through the registration process.
|
||||
Therefore, should the EPA find or if it is brought to our attention that a website contains statements or claims
|
||||
substantially differing from statements or claims made in connection with obtaining a FIFRA section 3
|
||||
registration, the website will be referred to the EPA’s Office of Enforcement and Compliance Assurance.

Environmental Hazards
|
||||
This pesticide is toxic to fish and aquatic invertebrates .
|
||||
Drift and runoff may be hazardous to aquatic organisms in
|
||||
water adjacent to treated areas . For terrestrial uses,
|
||||
DO NOT apply directly to water, or to areas where surface
|
||||
water is present, or intertidal areas below the mean high
|
||||
water mark . DO NOT contaminate water when cleaning
|
||||
equipment or disposing of equipment washwaters or
|
||||
rinsate .
|
||||
DO NOT discharge effluent containing this product into
|
||||
lakes, streams, ponds, estuaries, oceans, or other waters
|
||||
unless in accordance with the requirements of a National
|
||||
Pollutant Discharge Elimination System (NPDES) permit
|
||||
and the permitting authority has been notified in writing
|
||||
before discharge . DO NOT discharge effluent containing
|
||||
this product to sewer systems without previously notifying
|
||||
the local sewage treatment plant authority . For guidance,
|
||||
contact your State Water Board or the regional office of the
|
||||
EPA .
|
||||
Groundwater Advisory
|
||||
Fluxapyroxad, pyraclostrobin, and metalaxyl are known to
|
||||
leach through soil into groundwater under certain condi -
|
||||
tions as a result of label use . These chemicals may leach
|
||||
into groundwater if used in areas where soils are perme -
|
||||
able, particularly where the water table is shallow .
|
||||
Surface Water Advisory
|
||||
This product may impact surface water quality due to run -
|
||||
off of rain water . This is especially true for poorly draining
|
||||
soils and soils with shallow ground water . This product is
|
||||
classified as having a high potential for reaching surface
|
||||
water via runoff for several months or more after applica -
|
||||
tion . A level, well-maintained vegetative buffer strip
|
||||
between areas to which this product is applied and
|
||||
FIRST AID
|
||||
If swallowed
|
||||
• Call a poison control center or doctor immediately for treatment advice .
|
||||
• Have person sip a glass of water if able to swallow .
|
||||
• DO NOT induce vomiting unless told to do so by a poison control center or doctor .

|
||||
reduce this product’s contribution to surface water
|
||||
contamination .
|
||||
Treated seed exposed on soil surface may be hazardous
|
||||
to wildlife . Cover or collect seeds spilled during loading . If
|
||||
treated seed is spilled outdoors or in areas accessible to
|
||||
birds or endangered species, promptly clean up and dis -
|
||||
pose of (cover or collect) spilled treated seed to prevent
|
||||
ingestion . Dispose of all excess treated seed by burying
|
||||
seed away from bodies of water .
|
||||
Physical and Chemical Hazards
|
||||
DO NOT mix or allow coming in contact with oxidizing
|
||||

It is a violation of federal law to use this product in a man-

||||
ner inconsistent with its labeling . This labeling must be in
|
||||
the possession of the user at the time of fungicide seed
|
||||
treatment application .

||||
DO NOT APPLY this product in a way that will contact
|
||||
workers or other persons, either directly or through drift .
|
||||
Only protected handlers may be in the area during applica -
|
||||
tion . For any requirements specific to your state or tribe,
|
||||
consult the agency responsible for pesticide regulation .
|
||||
DO NOT mix or allow coming in contact with oxidizing
|
||||
agent . Hazardous chemical reaction may occur .
|
||||
Unless otherwise directed in supplemental labeling, all
|
||||
applicable directions, restrictions, precautions, and
|
||||
Conditions of Sale and Warranty are to be followed .
|
||||
AGRICULTURAL USE REQUIREMENTS
|
||||
Use this product only in accordance with its labeling and
|
||||
with the Worker Protection Standard, 40 CFR part 170 .
|
||||
This standard contains requirements for the protection
|
||||
of agricultural workers on farms, forests, nurseries, and
|
||||
greenhouses, and handlers of agricultural pesticides . It
|
||||
contains requirements for training, decontamination,
|
||||
notification, and emergency assistance . It also contains
|
||||
specific instructions and exceptions pertaining to the
|
||||
statements on this label about personal protective
|
||||
equipment (PPE) and the restricted-entry intervals . The
|
||||
requirements in this box only apply to uses of this prod-
|
||||
uct that are covered by the Worker Protection Standard .
|
||||
DO NOT enter or allow worker entry into treated areas
|
||||
during the restricted-entry interval (REI) of 48 hours .
|
||||
EXCEPTION: If the seed is treated with the product and
|
||||
the treated seed is soil-injected or soil-incorporated, the
|
||||
Worker Protection Standard, under certain circumstanc -
|
||||
es, allows workers to enter the treated area if there will
|
||||
be no contact with anything that has been treated .
|
||||
PPE required for early entry to treated areas permitted
|
||||
under the Worker Protection Standard and that involves
|
||||
contact with anything that has been treated, including
|
||||
plants, soil, or water, is:

equivalent) promptly after emptying; then offer for recy -

cling, if available, or reconditioning, if appropriate, or
|

puncture and dispose of in a sanitary landfill, or by incin -

(capacity > 5 gallons) as follows: Empty the remain-

ing contents into application equipment or a mix tank .

Fill the container 1/4 full with water . Replace and tighten
|
||||
closures . Tip container on its side and roll it back and
|
||||
forth, ensuring at least one complete revolution, for
|
||||
30 seconds . Stand the container on its end and tip it
|
||||
back and forth several times . Turn the container over
|
||||
onto its other end and tip it back and forth several times .
|
||||
Empty the rinsate into application equipment or a mix
|
||||
tank, or store rinsate for later use or disposal . Repeat
|
||||
this procedure two more times .
|
||||
Pressure rinse as follows: Empty the remaining con-
|
||||
tents into application equipment or mix tank and
|
||||
continue to drain for 10 seconds after the flow begins to
|
||||
drip . Hold container upside down over application
|
||||
equipment or mix tank, or collect rinsate for later use or
|
||||
disposal . Insert pressure rinsing nozzle in the side of the
|
||||
container and rinse at about 40 PSI for at least 30 sec -
|
||||
onds . Drain for 10 seconds after the flow begins to drip .
|
||||
Refillable Container. Refill this container with pesticide
|
||||
only . DO NOT reuse this container for any other purpose .
|
||||
Triple rinsing the container before final disposal is the
|
||||
responsibility of the person disposing of the container .
|
||||
Cleaning before refilling is the responsibility of the refiller .
|
||||
Triple rinse as follows: To clean the container before final
|
||||
disposal, empty the remaining contents from this container
|
||||
into application equipment or mix tank . Fill the container
|
||||
about 10% full with water . Agitate vigorously or recirculate
|
||||
water with the pump for 2 minutes . Pour or pump rinsate
|
||||
into application equipment or rinsate collection system .
|
||||
Repeat this rinsing procedure two more times .
|
||||
When this container is empty, replace the cap and seal all
|
||||
openings that have been opened during use; return the
|
||||
container to the point of purchase or to a designated
|
||||
location . This container must only be refilled with a pesti-
|
||||
cide product . Prior to refilling, inspect carefully for damage
|
||||
including cracks, punctures, abrasions, worn-out threads
|
||||
and closure devices . Check for leaks after refilling and
|
||||
before transport . DO NOT transport if this container is
|
||||
damaged or leaking . If the container is damaged, or leak-
|
||||
ing, or obsolete and not returned to the point of purchase
|
||||
or to a designated location, triple rinse emptied container
|
||||
and offer for recycling, if available, or dispose of container
|

in compliance with state and local regulations .

• When applying both metalaxyl- and mefenoxam-

||||
containing products to the same crop within the same
|

season, DO NOT apply more than the maximum yearly
|
||||
total application rate for the active ingredient as stated on
|
||||
the label of the product containing the lowest yearly total
|
||||
on that crop .
|
||||
• DO NOT plant crops within 12 months after planting
|
||||
Obvius Plus -treated seed unless permitted according to
|
||||
the seed labeling note .
|
||||
• DO NOT use the same auger or other seed treatment
|
||||
equipment for treating seed that will handle commercial
|
||||
or feed grains unless these have been thoroughly
|
||||
cleaned .
|
||||
• DO NOT store leftover treated seed where it could be
|
||||
mixed with untreated seed . Store treated seed in cool,
|
||||
dry conditions .

SEED CONTAINER LABEL REQUIREMENT
|
||||
The Federal Seed Act requires that containers contain -
|
||||
ing treated seeds shall be labeled with the following
|
||||
statements:
|
||||
• This seed has been treated with Obvius® Plus
|
||||
fungicide seed treatment , a fungicide containing
|
||||
pyraclostrobin , fluxapyroxad, metalaxyl , and
|
||||
thiophanate-methyl .
|
||||
• DO NOT use treated seed for food, feed or oil
|
||||
purposes .
|
||||
The U .S . Environmental Protection Agency requires the
|
||||
following statements on containers containing seed
|
||||
treated with fluxapyroxad, pyraclostrobin ,
|
||||
metalaxyl , and thiophanate-methyl :
|
||||
• Store treated seed away from food and feedstuffs .
|
||||
• DO NOT allow children, pets or livestock to have
|
||||
access to treated seed .
|
||||
• Wear long-sleeved shirt and long pants, shoes plus
|
||||
socks, and chemical-resistant gloves made of barrier
|
||||
laminate, butyl rubber ≥ 14 mils, nitrile rubber
|
||||
≥ 14 mils, neoprene rubber ≥ 14 mils, polyvinyl

||||
• Surface Water Advisory: This product may impact
|
||||
surface water quality due to runoff of rain water . This is
|
||||
especially true for poorly draining soils and soils with
|
||||
shallow ground water . This product is classified as
|
||||
having a high potential for reaching surface water via
|
||||
runoff for several months or more after application . A
|
||||
level, well-maintained vegetative buffer strip between
|
||||
areas to which this product is applied and surface
|
||||
water features including ponds, streams, and springs
|
||||
will reduce the potential loading of fluxapyroxad and
|
||||
pyraclostrobin from runoff water and sediment . Run-
|
||||
off of this product will be reduced by avoiding the
|
||||
planting of treated seed when rainfall or irrigation is
|
||||
expected to occur within 48 hours . Sound erosion
|
||||
control practices will reduce this product’s contribution
|
||||
to surface water contamination .
|
||||
• Groundwater Advisory: Fluxapyroxad ,
|
||||
pyraclostrobin and metalaxyl are known to leach
|
||||
through soil into groundwater under certain conditions
|
||||
as a result of label use . These chemicals may leach
|
||||
into groundwater if used in areas where soils are per-
|
||||
meable, particularly where the water table is shallow .
|
||||
• When applying both metalaxyl - and mefenoxam-
|
||||
containing products to the same crop within the same
|
||||
season, DO NOT apply more than the maximum year-
|
||||
ly total application rate for the active ingredient as
|
||||
stated on the label of the product containing the low-
|
||||
est yearly total on that crop .
|
||||
• In the event of crop failure or harvest of a crop grown
|
||||
from this seed, the field may be replanted immediately
|
||||
with dry beans, soybean, or any other crop which has
|
||||
tolerances for all active ingredients: fluxapyroxad,
|
||||
pyraclostrobin , metalaxyl , and
|
||||
thiophanate-methyl .
|
||||
• For crops with tolerance for fluxapyroxad, the mini-
|
||||
mum plant back interval is 30 days from the date this
|
||||
seed was planted .
|
||||
• For crops without a tolerance for fluxapyroxad, the
|
||||
plant back interval is 12 months .
|
||||
• A cover crop without one or more tolerances may be
|
||||
planted for purposes of erosion control or soil improve-
|
||||
ment; however, the crop may not be grazed or
|
||||
harvested for food or feed .

Product Information
|
||||
Obvius® Plus fungicide seed treatment , hereafter in
|
||||
this label referred to as Obvius Plus , is a liquid broad
|
||||
spectrum fungicide seed treatment that provides preven -
|
||||
tive seed and seedling protection from several seedborne
|
||||
and soilborne diseases .
|
||||
Refer to the Diseases Controlled by Obvius ® Plus
|
||||
fungicide seed treatment table for approved crops and
|
||||
associated diseases controlled by Obvius Plus .
|
||||
Mode of Action
|
||||
Obvius Plus contains four active ingredients from different
|
||||
fungicide groups that have distinct modes of action .
|
||||
• Pyraclostrobin is classified as a Target Site of Action
|
||||
Group 11 fungicide .
|
||||
• Fluxapyroxad is classified as a Target Site of Action
|
||||
Group 7 fungicide .
|
||||
• Metalaxyl is classified as a Target Site of Action Group 4
|
||||
fungicide .
|
||||
• Thiophanate-methyl is classified as a Target Site of
|
||||
Action Group 1 fungicide .
|
||||
Resistance Management
|
||||
Obvius Plus contains a Group 1 (thiophanate-methyl),
|
||||
Group 4 (metalaxyl), Group 7 (fluxapyroxad), and
|
||||
Group 11 (pyraclostrobin) fungicide . Any fungal population
|
||||
may contain individuals naturally resistant to Obvius Plus
|
||||
and other Group 1, Group 4, Group 7, and/or Group 11
|
||||
fungicides . A gradual or total loss of pest control may
|
||||
occur over time if these fungicides are used repeatedly in
|
||||
the same fields . Other resistance mechanisms that are not
|
||||
linked to site of action but specific for individual chemicals,
|
||||
including enhanced metabolism, may also exist . Follow
|
||||
appropriate resistance- management strategies .
|
||||
Due to the minimal amount of Obvius Plus applied to the
|
||||
seed that relocates to the upper parts of the plant and the
|
||||
multiple modes of action, the potential for development of
|
||||
resistance is extremely low . Seed treatments of
|
||||
Obvius Plus can therefore be followed by foliar use fungi-
|
||||
cides containing the same modes of action in accordance
|
||||
with resistance management guidelines as specified on
|
||||
the respective labels .
|
||||
To delay fungicide resistance, take one or more of the fol-
|
||||
lowing steps:
|
||||
• Rotate the use of Obvius Plus or other Group 1,
|
||||
Group 4 , Group 7, and/or Group 11 fungicides within a
|
||||
growing season sequence with different groups that
|
||||
control the same pathogens .
|
||||
• Use tank mixtures with fungicide from a different group
|
||||
that are equally effective on the target pest when such
|
||||
use is permitted . Use at least the minimum application
|
||||
rate as labeled by the manufacturer .
|
||||
• Adopt an integrated pest management (IPM) program for
|
||||
fungicide use that includes scouting, uses historical infor-
|
||||
mation related to pesticide use, and crop rotation, and
|
||||
which considers host plant resistance, impact of
|
||||
environmental conditions on disease development, dis -
|
||||
ease thresholds, as well as cultural, biological and other
|
||||
chemical control practices .
|
||||
• Where possible, make use of predictive disease models
|
||||
to effectively time fungicide applications . Note that using
|
||||
predictive models alone is not sufficient to manage
|
||||
resistance .
|
||||
• Monitor treated fungal populations for resistance devel -
|
||||
opment . Monitor the efficacy of all fungicides used in the
|
||||
disease management program against the targeted
|
||||
pathogen and record other factors that may influence
|
||||
fungicide performance and/or disease development .
|
||||
• Contact your local extension specialist or certified crop
|
||||
advisor for any additional pesticide resistance-
|
||||
management and/or IPM guidance for specific crops and
|
||||
pathogens .
|
||||
• For further information or to report suspected resistance,
|
||||
contact your BASF representative, local extension spe -
|
||||
cialist, or certified crop advisor .
|
||||
Application Instructions
|
||||
Seed must be well conditioned and free of chaff before
|
||||
treating with Obvius Plus . Uniform seed coverage and
|
||||
proper application equipment calibration is essential for
|
||||
good disease control . Weather conditions (hot or cold),
|
||||
seed type and surface, and equipment used all have a
|
||||
bearing on the uniformity of coverage .
|
||||
When applied at the indicated rate(s), dilution with water is
|
||||
not necessary unless advised by the manufacturer of the
|
||||
seed treatment application equipment . Consult a seed
|
||||
treatment specialist for calibration and operation proce -
|
||||
dures of the seed treatment equipment being used .
|
||||
Obvius Plus may be applied using standard commercial
|
||||
seed treatment equipment (including, but not limited to,
|
||||
slurry or mist-type equipment) or on-farm seed treatment
|
||||
equipment . Obvius Plus may also be used in on-the-go
|
||||
type air seeder treatment systems . DO NOT apply directly
|
||||
into a planter box .
|
||||
This product does not contain colorant . The purchaser of
|
||||
Obvius Plus is responsible for ensuring all seed treated
|
||||
with this product is adequately dyed with a suitable color
|
||||
to prevent accidental use as food for man or feed for ani-
|
||||
mals . Refer to 21 CFR, Part 2 .25 .
|
||||
• Use an EPA-approved dye or colorant that imparts an
|
||||
unnatural color to the seed .
|
||||
• Any dye or colorant added to treated seed must be
|
||||
cleared for use under 40 CFR, Part 180 .900,
|
||||
“ Exemptions from the requirement of a tolerance” .
|
||||
Federal regulations have established official tolerances or
|
||||
exemptions from tolerances for residues on food and for-
|
||||
age crops that must not be exceeded when the product
|
||||
(dye or colorant) is used at specified rates .
|
||||

Tank Mixing Information

|
||||
It is the pesticide user’s responsibility to ensure that all
|
||||
products are registered for the intended use . When using
|
||||
Obvius® Plus fungicide seed treatment in a tank mix-
|
||||
ture with other seed treatment products, read and follow
|
||||
all directions for use, crops/sites, application restrictions,
|
||||
dilution ratios, precautions, and limitations on the tank mix
|
||||
partner label . DO NOT exceed label dosage or application
|
||||
rate . Users must follow the most restrictive directions for
|
||||
use and precautionary statements of each product in the
|
||||
tank mixture . DO NOT combine with any product that pro-
|
||||
hibits mixing .
|
||||
Compatibility Test for Tank Mix
|
||||
Components
|
||||
When tank mixing Obvius Plus , always test compatibility
|
||||
before use by performing a jar test as follows:
|
||||
1 . Add all intended seed treatment products and the
|
||||
appropriate amount of water in a clear glass jar .
|
||||
2 . Mix well and allow to sit for one hour .
|
||||
3 . Remix and observe for physical incompatibility .
|
||||
Also test with the seed to ensure the combination of tank
|
||||
mix products does not have detrimental effects on the seed .
|
||||
Mixing Order
|
||||
For containers 5 gallons or less, shake well before use . For
|
||||
containers greater than 5 gallons, recirculate before use .
|
||||
1 . Water - Add 3/4 of the required volume of water to the
|
||||
mix tank and turn on agitation .
|
||||
2 . Agitation - Mechanical agitation is required for proper
|
||||
mixing of Obvius Plus .

product . Crop injury, ineffectiveness or other unintended
|
||||
consequences may result because of such factors as
|
||||
the presence of other or untested or unapproved
|
||||
materials, seed of low quality or low vigor or low
|
||||
germination, use of the product in a manner inconsistent
|
||||
with its labeling, misapplication of the product, or
|
||||
weather conditions at planting or environmental
|
||||
conditions during seed storage, all of which are beyond

||||
the control of BASF CORPORATION (“BASF”) or the

Seller . To the extent consistent with applicable law, all

such risks shall be assumed by the Buyer .

the purposes referred to in the Directions For Use ,
