In order to prot.ect health and the environment, the Administrato.r, on his motion, may at any time suspend or· cancel the registration· of ~ pesticide in accordance with the Act. The.acceptance of any name in connection with the registration of a product under this Act is not to be contrued as giving the registrant a right to exclusive use of the name or to its use if it has been covered by others. This product is reregistered in accordance with FIFRA section 4(g)(2)(C) provided you agree in writing to:

1. To revise the label as follows: A. Under "PRECAUTIONARY STATEMENTS" and "DANGER - PELlGRO", replace the entire paragraph starting with the sentence "Harmful if swallowed or, etc." with "CORROSIVE". CAUSESES IRREVERSIBLE EYE DAMAGE. Harmful if swallowed. Harmful if absorbed through skin. ( B. Under "PRECAUTIONARY STATEMENTS, and DANGER -PELlGRO" remove the "NON - WPS USES:" and "WPS USES:" sections, and replace them with "Mixers, loaders, applicators, flaggersand other handlers must wear:

• long-sleeved shirt and long pants .
• Protective eyewear (goggles or face shield)
• Chemical-resistant gloves (such as or made of any water-proof material)
• Shoes plus socks After the last bullet, add "Additional PPE requirements for mixers and loaders supporting aerial application to rangelands, pasture lands, or non-crop lands. These mixerslloaders also must wear:
• A chemical- resistant apron, and
• A NIOSH - approved respirator with a dust/mist filter with a NIOSH approval number prefix TC- 23C or any N, R, P, or HE filter. It is recommended that you require respirator wearers be fit tested, and trained in the proper use, maintenance, and limitations of the respirator. See ENGINEERING CONTROLS for .additional requir~ments." C. Under "ENGINEERING CONTROLS" add "Pilots must use an enclosed cockpit that meets the requirements listed in the Worker Protection Standard (WPS) for agricultural pesticides [40CFR170.240(d)(6)." , D. Under "USER SAFETY RECOMMENDATIONS", revise "Remove clothing immediately, etc." bullet to "Remove clothing/PPE immediately if pesticide gets inside. Then wash thoroughly and put on clean clothing." E. In the "FIRST AID" box, above the paragraph title "HOT LlNE·NUMBER", add "NOTE TO PHYSICAN: Probable mucosal damage may contraindicate the use of gastric lavage." Registrant - The proposed label should contain a Note to Physician which addresses the primary eye irritation Toxicity Category I. The following statements are some suggested types of information that could be included, ifapplicable, in the Note to Physicians:
• technical information on symptomatology
• use of supportive treatments to maintain life functions
• medicine that will counteract the specific physiological effects of the pesticide
• company telephone number to specific medical personnel who can provide specialized medical advice. F. Under the "ENVIRONMENTAL HAZARDS" statement, the first sentence "This pesticide may be toxic, etc." is not required, and can be deleted. . G. In the "NON-AGRICULTURAL USE REQUIREMENTS" box change the last two sentences to "Do not enter or allow people (other than applicator) or pets on treatment area during application. H. Under crop directions for barley, oats, rye, and wheat, remove the term "SMALL, GRAINS" and the parentheses around "BARLEY, OATS, RYE, AND WHEAT". Also remove term "LEGUMES" and the parenteses around "ALFALFA, LESPEDEZA, RED AND WHITE CLOVER". The term "SMALL GRAINS" does not necessary apply only to barley, oats, rye, and wheat, and the term "LEGUMES" does not necessary apply only to alfalfa, lespedeza, and red and white clover. To avoid confusion, use specific crops registered for inclusion on this label. Revise " ... to early boot stage." to " ... and before reaching boot stage. i • to conform to your other MCPA product label directions. ( ( PRECAUTIONARY STATEMENTS HAZARDS TO HUMANS AND DOMESTIC ANIMALS DANGER - PELIGRO Corrosive, causes irreversible eye damage. Do not get in eyes, on skin, or clothing. Avoid inhalation of spray mists. Harmful if swallowed, inhaled or absorbed through skin. . PERSONAL PROTECTIVE EQUIPMENT (PPE): Some materials that are chemical-resistant to this product are listed below. If you want more options, follow the instructions for category A on an EPA chemical-resistance category selection chart. . NON-WPS USES: Applicators and other handlers who handle this pesticide for any use NOT covered by the Worker Protection Standard (40 CFR Part 170) -- in general, only agricultural plant uses are covered by the WPS -- must wear: eye protection and chemical-resistant gloves. WPS USES: Personal Protective Equipment (PPE) - Applicators and other handlers who handle this pesticide for any use covered by the Worker Protection Standard (40 CFR Part 170) -- in general, agricultural plant uses are covered -- must wear: long-sleeved shirt, long pants, chemical-resistant gloves when mixing, loading, or using any hand-held equipment, shoes plus socks, and protective eyewear. Keep and wash PPE separately from other laundry. Engineering Controls Statements: When handlers use closed systems, enclosed cabs, or aircraft in a manner that meets the requirements listed in the Worker Protection Standard (WPS) for agricultural pesticides [40 CFR 170.240(d)(4-6)), the handler PPE requirements may be reduced or modified as specified in the WPS. USER SAFETY RECOMMENDATIONS Users Should: • Wash hands before eating, drinking, chewing gum, using tobacco or using the toilet. • Remove clothing immediately if pesticide gets inside. • RernovePPE immediately after handling this product. Wash the outside of gloves before removing. As soon as possible, wash thoroughly and change into clean clothing. FIRST AID IF IN EYES • Hold eye open and rinse slowly and gently' with water for 15 to 20 minutes. • Remove contact lenses, if present, after the firstS minutes, then continue rinsing eye. • Call a poison control center or doctor for treatment advice. IF SWALLOWED • Call a poison control center or doctor immediately for treatment advice. • Have person sip a glass of water if able to swallow. • Do not induce vomiting unless told to do so by the poison control center or doctor. • Do not give anything by mouth to an unconscious person. IFON SKIN • Take off contaminated clothing. OR CLOTHING • Rinse skin immediately with plenty of water for 15 to 20 minutes. • Call a poison control center or doctor for treatment advice. IF INHALED • Move person to fresh air. • If person is not breathing, call 911 or an ambulance, then give artificial respiration, preferably by mouth- to-mouth, if possible. • Call a poison control center or doctor for further treatment advice. You may also contact 1-8n-325-1840 for emergency medical treatment information. ENVIRONMENTAL HAZARDS This pesticide may be toxic to fish, aquatic invertebrates and aquatic plants. Do not apply directly to water, to areas where surface water is present, or to intertidal areas below the mean high water mark. Do not contaminate water when disposing of equipment washwater or rinsate. Drift and runoff may be hazardous to aquatic organisms in water adjacent to treated areas. Runoff of this product will be reduced by avoiding applications when rainfall is forecasted to occur within 48 hours. This chemical has properties and characteristics associated with chemicals detected in groundwater. The use of this chemical in areas where soils are permeable, particularly where the water table is shallow, may result in groundwater contamination. 2

( DIRECTIONS FOR USE It Is A Violation Of Federal Law To Use This Product In A Manner Inconsistent With Its Labeling. Read entire label before using this product. Use strictly in accordance with label precautionary statements and directions. Do not apply this product in a way that will contact workers or other persons, either directly or through drift. Only protected handlers may be in the area during application. For any requirements specific to your State or Tribe, consult the agency responsible for pesticide regulation. AGRICULTURAL USE REQUIREMENTS Use this product only in accordance with its labeling and with the Worker Protection Standard, 40 CFR Part 170. This standard contains requirements for the protection of agricultural workers on farms, forests, nurseries, and greenhouses, and handlers of agricultural pesticides. It contains requirements for training, decontamination, notification, and emergency assistance. It also contains specific in'structions and exceptions pertaining to the statements on this label about personal protective equipment (PPE) and restricted-entry intervals. The requirements in this box only apply to uses of this product that are covered by the Worker Protection Standard. Do not enter or allow worker entry into treated areas during the restricted-entry interval (REI) of 48 hours. PPE required for early entry to treated areas that is permitted under the Worker Protection Standard and that involves contact with anything that has been treated, such as plants, soil, or water, is coveralls, chemical-resistant gloves made of any waterproof material, shoes plus socks, and protective eyewear. NON-AGRICULTURAL USE REQUIREMENTS The requirements in this box apply to uses of this product that are NOT within the scope of the Worker Protection Standard for agricultural'pesticides (40 CFR Part 170). The WPS applies when this product is used to produce agricultural plants on farms, forests, nurseries, or greenhouses. Do not enter treated areas until spray has dried. GENERAL INFORMATION MCPA is effective on a large number of broadleaf weeds and is useful for controlling these weeds in certain crops. Several crops, such as flax, oats, and small grains underseeded to legumes, are more tolerant of MCPA than they are of 2,4-0. Crop varieties vary in response to MCPA, and some may be easily injured. Apply this product only to varieties known to be tolerant to MCPA. Injury to crops may occur from this pesticide. If you are not prepared to accept some degree of crop injury, do not use this product. If you are uncertain concerning tolerant varieties or local use situations that may affect crop tolerance to MCPA, contact your seed company or State Agricultural Extension Service for advice. NOTE: Adding oil, wetting agent or other surfactant to the spray may reduce selectivity to crops, possibly resulting in crop injury. Spray equipment used in applying this product should be thoroughly cleaned before using for any other purpose. Use repeated flushing with soap and warm water or suitable chemical cleaner. It is best to use a separate sprayer for application of insecticides and fungicides. This product will kill or seriously injure many desirable forms of vegetation. Do not apply directly to flowers, fruits, grapes, tomatoes, ornamentals, cotton or other desirable plants. Vapors from this product may injure susceptible plants in the immediate vicinity. A spray thickening agent, such as Nalco-Trol®, may be used with this product to aid in reducing spray drift. If used, follow all use recommendations and precautions on both product labels. Excessive amounts of this product in the soil may temporarily inhibit seed germination and plant gro1Mh. . Determine air movement and direction before foliar application. Use a smoke generator or other means at or near the application site for the detection of air movement, air stability, or temperature inversions. Such a condition exists when there is little or' no wind and air temperature is lower near the ground than at higher levels. SPRAY DRIFT MANAGEMENT Avoiding spray drift at the application site is the responsibility of the applicator. The interaction of many equipment-and-weather­ related factors determine the potential for spray drift. The applicator and the grower are responsible for conSidering all these factors when making decisions. Apply only as a medium or coarser spray (ASAE standard 572) or a volume mean diameter of 300 microns or greater for spinning atomizer nozzles. Apply only when the wind speed is 2-10 mph at the application site. Additional requirements for aerial applications: The boom length must. not exceed 75"10 of the wingspan or 90"10 or the rotor blade diameter. Release spray at the lowest height consistent with efficacy and flight safety. Do not release spray at a height greater than 10 feet· above the crop canopy. 3

( When applications are made with a crosswind, the swath will be displaced downwind. The applicator must compensate for this displacement at the downwind edge of the application area by adjusting the path of the aircraft upwind. Do not make applications into temperature inversions. Additional requirements for ground boom application: Do not apply with a nozzle height greater than 4 feet above the crop canopy. WEEDS CONTROLLED This product will control or kill the following weeds in addition to many other noxious plants susceptible to MCPA: More Susceptible Weeds (Most Areas): Arrowhead Cocklebur Goatsbeard Kochia Lambsquarters Less Susceptible Weeds: Buttercup Canada Thistle Dandelion Hempnettle Marshelder Mint (Dragonhead) Mustard Pepperweed (field) Puncturevine Hoary Cress Plantain Pigweed Purslane Ragweed Redstem Shepherdspurse Stinkweed Water Plantain Sow Thistle Stinging Nettle Sunflower Vetch Wild Radish Whitebrush Yellow Rocket (or Winter Cress) and many other species WhiteTop To ensure uniform results, shake container prior to opening and agitate prepared spray mixes thoroughly and continuously. Mix the recommended amount of product with enough carrier (e.g. water) to obtain adequate spray coverage. For aerial application, use up io 10 gallons and for surface applications up to 30 gallons of carrier per acre to obtain sufficient coverage, unless otherwise stated. . FIELD CROPS Flax: Use 1/6 to 1/3 pint of product per acre in enough water to obtain uniform and efficient coverage. Apply after weeds have emerged where flax is 4 to 8 inches tall, to first boot stage. DO NOT apply after bud formation. Do not apply more than 1/3 pint per acre per year. Canada thistle control may be incomplete. . SMALL GRAINS (BARLEY, OATS, RYE AND WHEAT) UNDERSEEDED WITH LEGUMES (ALFALFA, LESPEDEZA, RED AND WHITE CLOVER). Use 1/6 to 1/3 pint of product in 5 to 10 gallons of water under low pressure to control serious infestations of mustard, yellow rocket and other weeds. Apply spray mix after the tillering (4 to 8 inches tall) to early boot stage. Protective canopy of nursecrop and weeds together with the prescribed treatment will reduce injury to legumes. DO NOT apply to small grains underseeded with vetch or sweet clover; other legumes may be injured if protective vegetation canopy is too sparse. Do not apply more than 1 pint per acre per year. PASTURE LANDS 'Established Pastures: Use 2/3 to 2 pints of product per acre in enough water to provide adequate coverage. Use higher rate for control of less susceptible species, like Canada Thistle, White Top and other. Spray perennials in early bud to full bloom stage and during active regrowth in fall. Other weeds may be controlled during spring and fall. When clover and alfalfa are present, reduce rate' to 1/3 pint of product per acre. NOTE: If control is not satisfactory, repeat application. Legumes including white clover may be temporarily injured or killed. In some areas, bent, buffalo, carpet and SI. Augustine grasses may be susceptible to injury. Do not apply more than 2 pints per acre per application. Do not apply more than 2 applications per year with a minimum retreatment interval of 21 days. , NON-CROP USES Non-crop Areas (Fencerows, Fallowlands, Rlghts-ot-way, Roadsides and Similar Areas): Use 4 pints of product per acre in enough waterto give sufficient coverage. Do not apply more than 2 applications per year with a minimum retreatment interval of 21 days. For Spot Spraying in Non-Crop Areas, use 2-2/3 pints of product 'to 3 to 4 gallons of water. Wet target plants thoroughly during bud to full bloom period (spring) and active growth (fall). Do not plant crops until 3 months after treatment or until chemical has disappeared from the soil. Do not apply more than 4 pints of product per acre per year. 4

STORAGE AND DISPOSAL Do not contaminate water, food or feed by storage or disposal. ( PESTICIDE STORAGE: Always use original container to store pesticides in a secured warehouse or storage building. Store at temperature above 32°F. If allowed to freeze, warm to a least 40°F and remix before using. Freezing does not alter this product. Containers should be opened in well-ventilated areas. Keep container tightly sealed when not in use. Do not stack cardboard cases more than two pallets high. Do not store near open containers of fertilizer, seed or other pesticides. PESTICIDE DISPOSAL: Pesticide wastes are acutely hazardous. Improper disposal of excess pesticide, spray mixtures, or rinsate is a violation of Federal law. If container is damaged or if pesticide has leaked, contain all spillage. Absorb and clean up all spilled material with granules or sand. Place in a ·closed labeled container for proper disposal. If these wastes cannot be disposed of by use according to label instructions, contact your State Pesticide or Environmental Control Agency, or the Hazardous Waste representative at the nearest EPA Regional Office for guidance. CONTAINER DISPOSAL: Triple rinse (or equivalent). Then offer for recycling or reconditioning, or puncture and dispose of in a sanitary landfill, or by other procedures approved by State and Local authorities. Plastic containers also disposable by incineration, or if allowed by State and Local authorities by burning. If burned, stay out of smoke.
