The label referred to above, submitted in connection with registration under FIFRA, as amended, is acceptable.
Should you wish to add/retain a reference to the company’s website on your label, then please be aware that the website becomes labeling under the Federal Insecticide, Fungicide, and Rodenticide Act and is subject to review by the Agency. If the website is false or misleading, the product would be misbranded and unlawful to sell or distribute under FIFRA section 12(a)(1)(E). 40 CFR 156.10(a)(5) list examples of statements EPA may consider false or misleading. 3 x Chemical-resistant footwear plus socks Discard clothing and other absorbent materials that have been drenched or heavily contaminated with this product’s concentrate. Do not reuse them. Follow manufacturer’s instructions for cleaning/maintaining PPE. If no such instructions for washables exist, use detergent and hot water. Keep and wash PPE separately from other laundry. Respirator fit testing, medical qualification, and training Using a program that conforms to OSHA’s requiremen ts (see 29 CFR Part 1910.134), employers must verify that any handler who uses a respirator is: x Fit-tested and fit-checked, x Trained, and x Examined by a qualified medical practitioner to ensure physical ability to safely wear the style of respirator to be worn. A qualified medical practiti oner is a physician or other licensed health care professional who will evaluate the ability of a worker to wear a respirator. The initial evaluation consists of a questionnaire that asks about medical conditions (s uch as a heart condition) that would be problematic for respirator use. If concer ns are identified, then additional evaluations, such as a physical exam, might be necessary. The initial evaluation must be done before respirator use begins. Handlers must be reexamined by a qual ified medical practitioner if their health status or respirator style or use-conditions change. Upon request by local/state/federal /tribal enforcement personnel, employers must provide documentation demonstrating how they have complied with these requirements. Engineering Control Statements Mixers and loaders supporting aerial applications ar e required to use closed systems that provide dermal and inhalation protection. The closed system must be used in a manner that meets the requirements listed in the Worker Protection Standard (WPS) for agricultural pesticides [40 CFR 170.240(d)(4)]. When handlers use closed systems, enclosed cabs, or aircraft in a manner that meets the requirements listed in the Worker Protection Standard (WPS) for ag ricultural pesticides [40 CFR 170.240(d)(4-6)], the handler PPE requirements may be reduced or modified as specified in the WPS. USER SAFETY RECOMMENDATIONS Users Should: x Wash hands before eating, drinking, chewing gum, using tobacco or using the toilet. x Remove clothing/PPE immediately if pesticide gets inside. Then wash thoroughly and put on clean clothing. x Remove PPE immediately after handling this product. Wash the outside of gloves before removing. As soon as possible, wash thoroughly and change into clean clothing.
FIRST AID IF IN EYES: x If in eyes, IMMEDIATELY hold eye open and rinse thoroughly and gently with water for 15-20 minutes. x Remove contact lenses, if present, after the first 5 minutes and then continue rinsing eye. x Call a poison control center or doctor for treatment advice. IF SWALLOWED: x Call a poison control center or doctor immediately for treatment advice. x Have person sip a glass of water if able to swallow. x Do not induce vomiting unless told to do so by the poison control center or doctor. x Do not give anything by mouth to an unconscious person. IF ON SKIN OR CLOTHING: x Take off contaminated clothing. x Rinse skin immediately with plenty of water for 15 to20 minutes. x Call a poison control center or doctor for treatment advice. IF INHALED: x Move person to fresh air.
4 x If person is not breathing, call 911 or an ambulance, then give artificial respiration, preferably by mouth-to-mouth, if possible. x Call a poison control center or doctor for further treatment advice. You may also contact 1-877-325-1840 for emergency medical treatment information. NOTE TO PHYSICIAN To be effective, treatment for diquat poisoning must begin IMMEDIATELY. Treatment consists of binding diquat in the gut with suspensions of activated charcoal or bentonite clay, administration of cathartics to enhance elimination, and removal of diquat from th e blood by charcoal hemoperfusion or continuous hemodialysis. If in eyes, treat symptomatically. Symptoms may develop gradually. Severe damage may be caused by apparently trivial contact and healin g may be delayed. Medical supervision should be continued until healing is complete. ENVIRONMENTAL HAZARDS NON-TARGET ORGANISM ADVISORY: This product is toxic to plants and may adversely impact the forage and habitat of non-target organisms, including pollinators, in areas adjacent to the treated site. Protect the forage and habitat of non-target organisms by following label directions intended to minimize spray drift This pesticide is toxic to aquatic invertebrates. For Terrestrial Uses, do not apply directly to water, or to areas where surface water is present, or to intertidal areas below the mean high water mark. Do not contaminate water when disposing of equipment wash water. For Aquatic Uses, do not apply directly to water except as specified on this label. DIRECTIONS FOR USE It is a violation of Federal law to use this product in a manner inconsistent with its labeling. READ ENTIRE LABEL. USE STRICTLY IN A CCORDANCE WITH PRECAUTIONARY STATEMENTS AND DIRECTIONS, AND WITH APPLICABLE STATE AND FEDERAL REGULATIONS. Do not apply products containing diquat dibromide to production ornamentals at a rate more than 1 lb ai/A/year. Do not apply products containing diquat dibromide more than four times per year. Do not apply this product through any type of irrigation system. Do not apply this product in a way that will contact workers or other persons, either directly or through drift. Only protected handlers may be in the area during application. For any requirements specific to your State or Tribe, consult the agency responsible for pesticide regulation.

AGRICULTURAL USE REQUIREMENTS Use this product only in accordance with its labeling and with the Worker Protection Standard 40 CFR Part 170. This Standard contains requirements for the pr otection of agricultural workers on farms, forests, nurseries, and greenhouses, and handlers of agricultur al pesticides. It contains requirements for training, decontamination, notification, and emergency assistan ce. It also contains specific instructions and exceptions pertaining to the statements on this la bel about personal protecti ve equipment (PPE), and restricted-entry interval. The requirements in this box only apply to uses of this product that are covered by the Worker Protection Standard. Do not enter or allow worker entry into treated areas during the restricted-entry interval (REI) of 24 hours. PPE required for early entry to trea ted areas that is permitted under th e Worker Protection Standard and that involves contact with anything that has been treated, such as plants, soil, or water, is: x Coveralls over short-sleeved shirt and short pants, or coveralls over long-sleeved shirt and long pants x Chemical-resistant gloves made of any waterproof material x Chemical-resistant footwear plus socks x Protective eyewear x Chemical-resistant headgear for overhead exposure
NON-AGRICULTURAL USE REQUIREMENTS The requirements in this box apply to uses of this product that are NOT within the scope of the Worker Protection Standard for agricultural pesticides (40 CFR part 170). The WPS applies when this product is used to produce agricultural plants on farms, forests, nurseries, or greenhouses. Keep all unprotected persons out of
operating areas or vicinity where there may be drift. For terrestrial uses, do not enter or allow entry of maintenance workers into treated areas, or allow contact with treated vegetation wet with spray, dew, or rain, without appropriate protective clothing until spray has dried. For aquatic uses, do not enter treated areas while treatments are in progress. SPECIFIC USE DIRECTIONS This product is a herbicide used to control weeds in the following sites: x preharvest aid to desiccate labeled crops to facilitate harvesting x labeled nonbearing crops x noncrop or nonplanted areas on farms x aquatic areas x commercial greenhouses and nurseries x dormant established turfgrass (bermudagrass, zoysiagrass – nonfood or feed crop) x landscape, industrial, recreational, commercial, residential, and public areas x ornamental seed crops (flowers, bulbs, etc. – excluding the state of California) x turf renovation (all turf areas except commercial sod farms)
This product works by being absorbed by the weed, and, within a few days, the weed shows signs of dying. Optimum results are seen if the weeds are young, actively growing, and free from stress.
To avoid injury to desired crops, ornamentals or de sirable plants, use caution to prevent drift during application and clean all spray equipment thoroughly with water after use. Avoid application to muddy water or disturbing the water during application that reduce weed control. To avoid reduced herbicidal activity, do not use dirty or muddy water in preparing spray solutions of this product. Avoid application under conditions of high wind, water flow, or wave action.
6 Do not allow sprays to come in contact with or drift to, foliage of ornamental plants or food crops. Do not graze livestock on treated turf or feed treated thatch to livestock.
SPRAY DRIFT MANAGEMENT Mandatory Spray Drift Directions
Aerial Applications x Do not release spray at a height greater than 10 ft above the vegetative canopy, unless a greater application height is necessary for pilot safety. x For all applications, applicators are required to use a medium or coarser spray droplet size (ASABE S572.1). x The boom length must not exceed 65% of the wingspan for airplanes or 75% of the rotor blade diameter for helicopters. x Applicators must use ½ swath displacement up wind at the downwind edge of the field. x Nozzles must be oriented so the spray is directed toward the back of the aircraft. x Do not apply when wind speeds exceed 10 miles per hour at the application site. x Do not apply during temperature inversions. Groundboom Applications x Apply with the nozzle height recommended by the manufacturer, but no more than 4 feet above the ground or crop canopy. x For all applications, applicators are required to use a medium or coarser spray droplet size (ASABE S572.1). x Do not apply when wind speeds exceed 15 miles per hour at the application site. x Do not apply during temperature inversions. Boom-less Ground Applications: x Applicators are required to use a medium or coarser droplet size (ASABE S572.1) for all applications. x Do not apply when wind speeds exceed 15 miles per hour at the application site. x Do not apply during temperature inversions.
Spray Drift Advisories
THE APPLICATOR IS RESPONSIBLE FOR AVOIDING OFF-SITE SPRAY DRIFT. BE AWARE OF NEARBY NON-TARGET SITES AND ENVIRONMENTAL CONDITIONS.
IMPORTANCE OF DROPLET SIZE An effective way to reduce spray drift is to apply large droplets. Use the largest droplets that provide target pest control. While applying larger droplets will reduce spray drift, the potential for drift will be greater if applications are made improperly or under unfavorable environmental conditions.
Controlling Droplet Size - Ground Boom x Volume - Increasing the spray volume so that larger droplets are produced will reduce spray drift. Use the highest practical spray volume for the application. If a greater spray volume is needed, consider using a nozzle with a higher flow rate. x Pressure - Use the lowest spray pressure recommended for the nozzle to produce the target spray volume and droplet size. x Spray Nozzle - Use a spray nozzle that is designed for the intended application. Consider using nozzles designed to reduce drift. Controlling Droplet Size - Aircraft x Adjust Nozzles - Follow nozzle manufacturers recommendations for setting up nozzles. Generally, to reduce fine droplets, nozzles should be oriented parallel with the airflow in flight.
7 BOOM HEIGHT - Ground Boom Use the lowest boom height that is compatible with the spray nozzles that will provide uniform coverage. For ground equipment, the boom should remain level with the crop and have minimal bounce. RELEASE HEIGHT - Aircraft Higher release heights increase the potential for spray drift. When applying aerially to crops, do not release spray at a height greater than 10 ft above the crop canopy, unless a greater application height is necessary for pilot safety. SHIELDED SPRAYERS Shielding the boom or individual nozzles can reduce spray drift. Consider using shielded sprayers. Verify that the shields are not interfering with the uniform deposition of the spray on the target area. TEMPERATURE AND HUMIDITY When making applications in hot and dry conditions, use larger droplets to reduce effects of evaporation. TEMPERATURE INVERSIONS Drift potential is high during a temperature inversion. Temperature inversions are characterized by increasing temperature with altitude and are common on nights with limited cloud cover and light to no wind. The presence of an inversion can be indicated by ground fog or by the movement of smoke from a ground source or an aircraft smoke generator. Smoke that layers and moves laterally in a concentrated cloud (under low wind conditions) indicates an inversion, while smoke that moves upward and rapidly dissipates indicates good vertical air mixing. Avoid applications during temperature inversions. WIND Drift potential generally increases with wind speed. AVOID APPLICATIONS DURING GUSTY WIND CONDITIONS. Applicators need to be familiar with local wind patterns and terrain that could affect spray drift. Boom-less Ground Applications: Setting nozzles at the lowest effective height will help to reduce the potential for spray drift. Handheld Technology Applications: Take precautions to minimize spray drift.
WEED RESISTANCE MANAGEMENT For resistance management, this prod uct contains a Group 22 herbicide – diquat dibromide. Any weed population may contain or develop plants naturally resistant to diquat dibr omide and other Group 22 herbicides. The resistant biotypes may dominate th e weed population if these herbicides are used repeatedly in the same field. Appropriate resistance management strategies should be followed.
When herbicides that affect the same biological site of action are used repeatedly over several years to control the same weed species in the same field, naturally-occurring resistant biotypes may survive a correctly applied herbicide treatment, propagate, and be come dominant in that field. Adequate control of these resistant weed biotypes cannot be expected. If weed control is unsatisfactory, it may be necessary to retreat the problem area using a product affecting a different site of action.
To delay herbicide resistance take one or more of the following steps:
• Rotate the use of this product or other Group 22 herbicides within a growing season sequence or among growing seasons with different herbicide groups that control the same weeds in a field.
• Use tank mixtures with herbicides from a different group if such use is permitted; where information on resistance in target weed species is available, use the less resistance-prone partner at a rate that will control the target weed(s) equally as well as the more resi stance-prone partner. Consult your local extension service or certified crop advisor if you are unsure as to which active ingredient is currently less prone to resistance.
• Adopt an integrated weed -management program for herbicide use that includes scouting and uses historical information related to herbicide use and cr op rotation, and that considers tillage ( or other
8 mechanical control methods), cultural ( e.g., higher crop seeding rates; precision fertilizer application method and timing to favor the crop and not the weeds), biological (weed-competitive crops or varieties) and other management practices.
• Scout after herbicide application to monitor weed po pulations for early signs of resistance development. Indicators of possible herbicide resistance include: (1) failure to control a weed species normally controlled by the herbicide at the dose applied, especially if control is achieved on adjacent weeds; (2) a spreading patch of non-controlled plants of a particular weed species; (3) surv iving plants mixed with controlled individuals of the same species. If resistance is susp ected, prevent weed seed production in the affected area by an alternative herbicide from a different group or by a mechanical method such as hoeing or tillage. Prevent movement of resistant weed seeds to other fi elds by cleaning harvesti ng and tillage equipment when moving between fields, and planting clean seed.
• If a weed pest population continues to progress after treatment with this product, discontinue use of this product, and switch to another management strategy or herbicide with a different mode of action, if available.
• Contact your local extension specialist or certifie d crop advisors for additional pesticide resistance - management and/or integrated weed-management recommendations for specific crops and weed biotypes.
• [For further information or to report suspected resistance, contact your Nufarm representative at 855-280- 6609.] It is advisable to keep accurate records of pesticides ap plied to individual fields to help obtain information on the spread and dispersal of resistant biotypes. Contact your local sales representative, crop advisor, or extension agent to find out if suspected resistant weeds to this MOA have been found in your region. Do not assume that each listed weed is being controlled by this mechanisms of action. Co-formulated active ingredients are intended to broaden the spectrum of weeds that are controlled. Some weeds may be controlled by only one of the active ingredient in this product.
Suspected herbicide-resistant weeds may be identified by these indicators:
- Failure to control a weed species normally cont rolled by the herbicide at the dose applied, especially if control is achieved on adjacent weeds;
- A spreading patch of non-controlled plants of a particular weed species; and
- Surviving plants mixed with controlled individuals of the same species. AGRICULTURAL USES Apply this product to dessicate certain crops as a prehar vest aid to facilitate harvesting. This product can also be applied as a general herbicide to control weeds in nonbearing crops and noncrop areas. This product acts on contact with actively growing gr een plant tissue and for effective control, complete coverage of all green plant tissue is required. Signs of herbicidal activity are usually apparent within a few days of application. Improper application technique and/or application to large, stressed, or mowed weeds will generally result in unacceptable control. Weeds that emerge after application of this product will not be controlled or suppressed. Weeds that are established or larger than 6” my require retreatment. NOTE: Cool (below 55°F) or cloudy, overcast weather will slow this product activity but will not affect performance. APPLICATION INSTRUCTIONS Apply this product to newly emerged weeds while ac tively growing and before they become too large (weeds 1 - 6 inches in height are easiest to control). Be sure to follow the specified rates listed in the specific crop instructions below, using the higher rates when weeds are large or dense or when applying for harvest aid and the crop vegetation is dense. If weeds have been mowed or grazed (removing much of the green foliage) be sure to allow weeds to regrow to a height of 2 - 4 inches before application. For harvest aid applications, refer to the specific crop instructions below for application timing specifications. NOTE: Because dust can coat target surfaces and re duce product activity, avoid applying in extremely dusty conditions (e.g., dust caused by high winds or the passage of equipment tires). Spray Equipment Be sure to follow the specific instructions for minimum spray volumes listed in the crop specific instructions below. Note that the specifications are minimum volumes only, and increase spray volumes as necessary to obtain complete coverage of the target weed or pl ant (without causing foliage runoff). For best results use flat fan nozzles. Other nozzles provide less than complete coverage resulting in reduced performance. NOTE: When spraying less than 20 gals. of spray carrier per acre, target weeds must not exceed 6 inches in height. Adjuvants When applying this product, be sure to always add one of the following adjuvants: Nonionic Surfactant (NIS) - Add a NIS containing 75% or greater surface active agent at 0.06-0.5% v/v (1/2 – 4 pts. per 100 gals.) of the finished spray volume. Other Adjuvants - Use adjuvants other than NIS but that meet the following criteria: x Contains only EPA exempt ingredients. x Is compatible when mixed with this product (compatibility can be determined using a jar test). x Is supported locally for use with this product thro ugh proven field trials and through university and extension recommendations.

This product is used to control aquatic weeds in public waters such as ponds, lakes, reservoirs, marshes, bayous, drainage ditches, canals, streams, rivers, and other slow-moving or quiescent bodies of water. Do not apply to water that is moving or if outflow leads to public waters (i.e., apply only to still water ponds, lakes and drainage ditches). Optimum control of submersed weeds is obtained by applying this product when the weeds are actively growing (photosynthesizing), typically when water temperatures are about 50°F or more (this occurs usually in the Spring or early Summer).
13 Precautions and Restrictions: x Obtain all necessary approval and/or permits before application if required. Consult the responsible state agencies (i.e., Fish and Game Agencies, State Water Conservation authorities, or Department of Natural Resources). x Apply this product by those applicators certified for aquatic pest control authorized by the State or local government, Federal or State public agencies su ch as Water Management District personnel and municipal officials, and by Corps of Engineers. x For water bodies containing dense weeds, apply this pr oduct to only 1/3 to ½ of the water body area at one time. If a repeat application is required, wait for 14 days. Using this product in this manner will prevent loss of oxygen in the water body which occurs when dead weeds begin to decompose which often leads to suffocation of fish. x Do not apply this product in areas where commercial processing of fish which produces fish protein concentrate or fish meal is practiced. Prior to application, coordinate application with and obtain approval from local and/or State authorities. x Use water treated with this product only after the specified number of days have passed after application (refer to the table below for these water us e restrictions). Alternatively, use the water at a different time after application only if an approved assay (ex. PAM II Spectrometric Method) shows that no more than the designated maximum contaminant level goal (MCLG) of 0.02 mg/L (ppm) of diquat dibromide (calculated as the cation) is present in the water. x Do not apply this product on cattails ( Typha spp.) as a target weed species. x If posting is required by your St ate or Tribe, consult the agency responsible for pesticide regulations for specific details. x Do not apply this product at a rate greater than 2.5 lb ai/surface-acre per application for the control of floating, emergent, or marginal vegetation. Treatment of aquatic weeds and algae can result in oxygen loss from decomposition of dead biomass. This oxygen loss can cause fish and invertebrate suffocation. To minimize this hazard, do not use products containing diquat dibromide to treat more than ½ of the water body (excluding water infrastructure and constructed conveyances such as drainage canals, ditches and pipelines or intakes and aqueducts for drinking water or irrigation use) to avoid depletion of oxygen due to decaying vegetation. Wait at least 7 days between diquat dibromide applications to adjacent treatment areas within the same waterbody. Begin treatment along the shore and proceed outward in bands to allow fish to move into untreated areas. Consult with the state or local agency with primary responsibility for regulating pesticides before applying this product to public waters to determine if a permit is required. Use the higher rate for mixed weed populations. Do not use surface spray applications for densely- packed submersed weeds or if water is over 2 feet deep (use subsurface applications of this product in these situations). The use of a vehicle-mounted boom sprayer to apply this product above the water surface for treatment of floating, emergent, or marginal vegetation, except for applications made via aircraft, is prohibited. This prohibition does not apply to applications made below the water surface via submersed or trailing hoses. COMMERCIAL GREENHOUSES AND NURSERIES Use this product for general weed control in commer cial greenhouses (ex., beneath benches), for field grown and container stock, and in other similar areas. Make applications of this product preplant or postplant preemergence in field grown ornamental nu rsery plantings, or postemergence as a directed spray. For ornamental seed crops (NOT registered for use in the State of California), apply this product preemergence. Do not allow sprays to contact desirable foliage or injury will occur. Do not allow sprays to contact desirable plant foliage or injury will occur. To be effective as a contact/desiccant herbicide, this product must completely cover the target weeds. Best results are seen when this product is applied to young, actively growing weeds. Do not apply to weeds that are growing under stress. Use the specified application techniques for acceptable weed control. For weeds that are difficult to control, such as perennial, or deeply-rooted weeds, control is often obtained by applications of this product as a tank mix with other systemic-type herbicides. This product, when applied as a tank-mix with a preemergent herbicide labeled for th e intended use site, will provide residual control. Before preparing large volume of a tank-mix of this pr oduct with other herbicides, check that the tank-mix is physically compatible by mixing only a small amount of the tank mix. If the mixture balls up, forms flakes, sludges, jells, oily films or layers, or other precipitates, do not use this combination: it is not compatible. Read and follow the other product labels for specific application directions. It is not possible for Nufarm to test all possible tank mixtures of this product with other pesticides for compatibility, efficacy, or other adverse effects. Consult your state experimental station, state university or extension agent before tank-mixing this product with other herbicides. Grounds maintenance weed control in public, commer cial and residential landscapes, including landscape beds, lawns, golf courses and roadsides: Apply this product as a spot or broadcast spray to control weeds in listed sites or to control weeds around the edges and non-flooded portions of ponds, lakes and ditches. Trim and Edge weed control along driveways, walkways, patios, cart paths, fence lines, and around trees, ornamental gardens, buildings, other st ructures, and beneath non-commercial greenhouse benches: This product can be used to eliminate undesired grass and broadleaf plant growth in narrow- banded areas along the areas listed. Since this product does not translocate systemically, it can be used as an edging or pruning tool. This product must be applied only to the select, narrow-banded areas of grass or undesirable weed growth found in desirable ornamental bedding plants, ground covers , etc. This product will only control vegetation growing within the width of the spray application. Broadcast (Air or Ground) Applications: 1.5 to 2 pts. of this product plus a nonionic surfactant (contains 75% or greater nonionic surfactant) at the manufacturer’s specified rate per acre. Apply in sufficient amount of water (minimum of 5 gallons by air; 15 gallons by ground) to ensure desiccation and weed burndown. Make repeat applications at a minimum of 5-day intervals and do not apply more than three applications. Do not use seed, screenings, or waste as feed or for consumption. TURF RENOVATION (ALL TURF AREAS EXCEPT COMMERCIAL SOD FARMS) This product is used to desiccate golf course turf and other turf areas prior to renovation. For suppression of regrowth and quick desiccation of treated turfgrass, use this product as a tank mix with other systemic non-selective or systemic postemergence grassy weed herbicides. Before tank mixing with other products, read and follow the other product labels for specific application directions and restrictions. Increased water volumes (100 gal. of water per acre) will enhance turf desiccation, especially when turfgrass is dense and thick. Empty the rinsate into application equipment or a mix tank or store rinsate for later use or disposal. Repeat this procedure two more times. Pressure rinse as follows: Empty the rema ining contents into application equipment or a mix tank and continue to drain for 10 seconds after the flow begins to drip. Hold container upside down over application equipment or mix tank or collect rinsate for later use or disposal. Insert
19 pressure-rinsing nozzle in the side of the container, and rinse at about 40 psi for at least 30 seconds. Drain for 10 seconds after the flow begins to drip. Refillable containers larger than 5 gallons: Refillable container. Refill this container with pesticide only. Do not reuse this container for any other purpose. Cl eaning the container before final disposal is the responsibility of the person disposing of the container. Cleaning before refilling is the responsibility of the refiller. To clean the container before final disposal, empty the remaining contents from this container into application equipment or a mix tank. Fill the containe r about 10% full with water. Agitate vigorously or recirculate water with the pump for two minutes. Pour or pump rinsate into application equipment or rinsate collection system. Repeat this rinsing procedure two more times.

LIMITATION OF LIABILITY TO THE EXTENT CONSISTENT WITH APPLICABLE LAW, IN NO EVENT SHALL MANUFACTURER OR SELLER BE LIABLE FOR SPECIAL, INCIDENT AL, OR CONSEQUENTIAL DAMAGES, OR FOR DAMAGES IN THEIR NATURE OF PENALTIES RE LATING TO THE GOODS SOLD, INCLUDING USE, APPLICATION, HANDLING, AND DISPOSAL. TO THE EXTENT CONSISTENT WITH APPLICABLE LAW, MANUFACTURER OR SELLER SHALL NOT BE LIABLE TO BUYER OR USER BY WAY OF INDEMNIFICATION TO BUYER OR TO CUSTOMERS OF BUYER, IF ANY, OR FOR ANY DAMAGES OR SUMS OF MONEY, CLAIMS OR DEMANDS WHATSOEVER, RESULTING FROM OR BY REASON OF, OR RISING OUT OF THE MISUSE, OR FAILURE TO FOLLOW LABEL WARNINGS OR INSTRUCTIONS FOR USE, OF THE GOODS SOLD BY MANUFACTURER OR SELLER TO BUYER. ALL SUCH RISKS SHALL BE ASSUMED BY THE BUYER, USER, OR ITS CUSTOMERS. TO THE EXTENT CONSISTENT WITH APPLICABLE LAW, BUYER'S OR USER'S EXCLUSIVE REMEDY, AND MANUFACTURER'S OR SELLER'S TOTAL LIABILITY SHALL BE FOR DAMAGES NOT EXCEEDING THE COST OF THE PRODUCT.
