The amended label referred to above, submitted in connection with registration under the
|
||
Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), as amended, is acceptable. This
|
||
approval does not affect any conditions that were previously imposed on this registration. You
|
||
continue to be subject to existing conditions on your registration and any deadlines connected
|
||
with them.
|
||
|
||
A stamped copy of your labeling is enclosed for your records. This labeling supersedes all
|
||
previously accepted labeling. You must submit one copy of the final printed labeling before you
|
||
release the product for shipment with the new labeling. In accordance with 40 CFR 152.130(c),
|
||
you may distribute or sell this product under the previously approved labeling for 18 months
|
||
from the date of this letter. After 18 months, you may only distribute or sell this product if it
|
||
bears this new revised labeling or subsequently approved labeling. “To distribute or sell” is
|
||
defined under FIFRA section 2(gg) and its implementing regulation at 40 CFR 152.3.
|
||
|
||
Should you wish to add/retain a reference to the company’s website on your label, then please
|
||
be aware that the website becomes labeling under FIFRA and is subject to review by the
|
||
Agency. If the website is false or misleading, the product would be misbranded and unlawful to
|
||
sell or distribute under FIFRA section 12(a)(1)(E). 40 CFR 156.10(a)(5) lists examples of
|
||
statements EPA may consider false or misleading. In addition, regardless of whether a website
|
||
is referenced on your product’s label, claims made on the website may not substantially differ
|
||
from those claims approved through the registration process. Therefore, should the Agency find
|
||
|
||

or if it is brought to our attention that a website contains false or misleading statements or
|
||
claims substantially differing from the EPA approved registration, the website will be referred

||
conditions are not complied with, the registration will be subject to cancellation in accordance
|
||
with FIFRA section 6.

FIRST AID
|
||
Acephate is an organophosphate, cholinesterase inhibitor.
|
||
If swallowed: • Call a poison control center or doctor immediately for treatment advice.
|
||
• Have person sip a glass of water if able to swallow.
|
||
• Do not induce vomiting unless told to by a poison control center or doctor.
|
||
• Do not give anything by mouth to an unconscious person.
|
||
If in eyes: • Hold eye open and rinse slowly and gently with water for 15-20 minutes.
|
||
• Remove contact lenses, if present, after the first 5 minutes, then continue rinsing eye.
|
||
• Call a poison control center or doctor for treatment advice.
|
||
If on skin or
|
||
clothing:
|
||
• Take off contaminated clothing.
|
||
• Rinse skin immediately with plenty of water for 15-20 minutes.
|
||
• Call a poison control center or doctor for treatment advice.
|
||
If inhaled: • Move person to fresh air.
|
||
• If person is not breathing, call 911 or an ambulance, then give artificial respiration,
|
||
preferably by mouth-to-mouth, if possible.
|
||
• Call a poison control center or doctor for further treatment advice.
|

NOTE TO PHYSICIAN
|
||
This material contains a cholinesterase inhibitor. Measurement of blood cholinesterase activity may be useful in
|
||
monitoring exposure but decisions regarding treatment will usually need to be made before test results are
|
||
available. If signs of cholinesterase inhibition appear, atropine sulfate is antidotal. 2- PAM (PROTOPAM) is also
|
||
antidotal and may be used in conjunction with atropine but should not be used alone.
|

PRECAUTIONARY STATEMENTS
|
||
HAZARDS TO HUMANS & DOMESTIC ANIMALS
|
||
CAUTION
|
||
Harmful if swallowed. Avoid contact with eyes, skin and clothing. Avoid breathing dust or spray mist. Wash hands
|
||
thoroughly with soap and water after handling and before eating, drinking, chewing gum, using tobacco, or using the
|
||
toilet. Remove and wash clothing before reuse.
|
||
|
||
PERSONAL PROTECTIVE EQUIPMENT (PPE):
|
||
|
||
Mixers, Loaders, Applicators and Other Handlers must wear:
|
||
• Long-sleeved shirt and long pants,
|
||
• Chemical-resistant gloves made of any waterproof material.
|
||
• Socks plus shoes.
|
||
|
||
In addition, Mixers and Loader supporting hopper box seed treatments must wear:
|
||
A minimum of a NIOSH-approved particulate filtering facepiece respirator with any N, R, or P filter; OR a NIOSH -
|
||
approved elastomeric particulate respirator with any N, R, or P filter; OR a NIOSH -approved powered air-purifying
|
||
respirator with a HE filter.
|
||
|
||
In addition, Applicators using low pressure hand wand application equipment must wear:
|
||
|
||
A minimum of a NIOSH-approved particulate filtering facepiece respirator with any N, R, or P filter; OR a NIOSH -
|
||
approved elastomeric particulate respirator with any N, R, or P filter; OR a NIOSH -approved powered air-purifying
|
||
respirator with a HE filter.
|
||
|
||
See Engineering Controls for additional requirements.
|
||
Engineering Controls:
|
||
Water soluble packets, when used correctly, qualify as a closed mixing/loading system under the Worker Protection
|
||
Standard [40 CFR 170.607(d)]. Mixers and loaders handling this product while it is enclosed in intact water soluble
|
||
packets may elect to wear reduced PPE of long -sleeved shirt, long pants, shoes, socks. When reduced PPE is worn
|
||
because a closed system is being used, handlers must be provided all PPE specified above for “applicators and other
|
||
handlers” and have such PPE immediately available for use in an emergency, such as a spill or equipment
|
||
breakdown.
|
||
|
||
Pilots must use an enclosed cockpit in a manner that meets the requirements listed in the Worker Protection
|
||
Standard (WPS) for agricultural pesticides [40 CFR 170.240(d)(6)].
|
||
|
||
Follow manufacturer’s instructions for cleaning/maintaining PPE. If no such instructions for washables exist, use
|
||
detergent and hot water. Keep and wash PPE separately from other laundry. As soon as possible, wash thoroughly
|
||
and change into clean clothing.
|
||
|
||
The use of human flaggers is prohibited.
|
||
|
||

||
USER SAFETY RECOMMENDATIONS
|
||
Users should:
|
||
• Wash hands before eating, drinking, chewing gum, using tobacco or using the toilet .
|
||
• Remove clothing/PPE immediately if pesticide gets inside. Then was thoroughly and put on clean clothing.
|
||
• Remove PPE immediately after handling this product. Wash the outside of gloves before removing. As soon as
|
||
possible, wash thoroughly and change into clean clothing.
|
||
ENVIRONMENTAL HAZARDS
|
||
This pesticide is toxic to birds. For terrestrial uses, do not apply directly to water, or to areas where surface water is
|
||
present or to intertidal areas below the mean high water mark. Do not contaminate water when cleaning equipment
|
||
or disposing of equipment washwaters. Cover or soil-incorporate spills.
|
||
|
||
Do not discharge effluent containing this product into lakes, streams, ponds, estuaries, oceans or other waters unless
|
||
in accordance with the requirements of a National Pollutant Discharge Elimination System (NPDES) permit and the
|
||
permitting authority has been notified in writing prior to discharge. Do not discharge effluent containing this product
|
||
to sewer systems without previously notifying the local sewage treatment plant authority. For guidance , contact your
|
||
State Water Board or Regional Office of the EPA.
|
||
|
||
|
||
This product and its degradate are highly toxic to bees exposed to direct treatment on blooming crops or weeds. Do
|
||
not apply this product or allow it to drift to blooming crops or weeds while bees are actively visiting the treatment
|
||
area.
|
||
|
||
Exposed treated seed may be hazardous to birds and other wildlife. Dispose of all excess treated seed and seed
|
||
packaging by burial away from bodies of water.
|
||
|
||
DIRECTIONS FOR USE
|
||
It is a violation of Federal law to use this product in a manner inconsistent with its labeling.
|
||
|
||
READ ENTIRE LABEL. USE STRICTLY IN ACCORDANCE WITH PRECAUTIONARY STATEMENTS
|
||
AND DIRECTIONS, AND WITH APPLICABLE STATE AND FEDERAL REGULATIONS.
|
||
|
||
Do not apply this product in a way that will contact workers or other persons, either directly or through drift. Only
|
||
protected handlers may be in the area during application. For any requirements specific to your State or Tribe,
|
||
consult the agency responsible for pesticide regulation.
|
||
|
||
AGRICULTURAL USE REQUIREMENTS
|
||
|
||
Use this product only in accordance with its labeling and with the Worker Protection Standard, 40 CFR part 170.
|
||
This Standard contains requirements for the protection of agricultural workers on farms, forests, nurseries and
|
||
greenhouses, and handlers of agricultural pesticides. It contains requirements for training, decontamination,
|
||
notification and emergency assistance. It also contains specific instructions and exceptions pertaining to the
|
||
statements on this label about personal protective equipment (PPE) and restricted-entry interval. The requirements in
|
||
this box only apply to uses of this product that are covered by the Worker Protection Standard.
|
||
|
||
Do not enter or allow worker entry into treated areas during the restricted -entry interval (REI) of 24 hours.
|
||
|
||
PPE required for early entry to treated areas that is permitted under the Worker Protection Standard and that
|
||
involves contact with anything that has been treated, such as plants, soil, or water, is:
|
||
• coveralls,
|
||
• chemical-resistant gloves made of any waterproof material,
|
||
• shoes plus socks.
|
||
|
||
NON-AGRICULTURAL USE REQUIREMENTS
|
||
|
||
The requirements in this box apply to uses of this product that are NOT within the scope of the Worker Protection Standard for
|
||
agricultural pesticides (40 CFR Part 170). The WPS applies when this product is used to produce agricultural plants on farms,
|
||
forests, nurseries or greenhouses.
|
||
|
||
Do not enter or allow others to enter until sprays have dried or dusts have settled.

||
TANK MIXES
|
||
It is the pesticide user's responsibility to ensure that all products are registered for the intended use. Read and follow the applicable
|
||
restrictions and limitations and directions for use on all product labels involved in tank mixing. Users must follow the most restrictive
|
||
directions for use and precautionary statements of each product in the tank mixture.
|
||
|
||
|
||
Read and follow the entire label of each product to be used in the tank mix with this product.
|
||
|
||
WATER SOLUBLE PACKAGING
|
||
|
||
Instructions for Using Water Soluble Packages Directly into Spray tanks:
|
||
|
||
Water Soluble Packages (WSPs) are designed to dissolve in water. Agitation may be used, if necessary, to help
|
||
dissolve the WSP. Failure to follow handling and mixing instructions can increase your exposure to the pesticide
|
||
products in WSPs. WSPs, when used properly, qualify as a closed mixing/loading system under the Agricultural
|
||
Worker Protection Standard [40 CFR 170.607(d)].
|
||
|
||
Handling Instructions
|
||
Follow these steps when handling pesticide products in WSPs.
|
||
|
||
1. Mix in spray tank only.
|
||
2. Handle WSP(s) in a manner that protects package from breakage and/or unintended release of contents. If
|
||
package is broken, put on PPE required for clean-up and then continue with mixing instructions.
|
||
3. Keep the WSP(s) in outer packaging until just before use.
|
||
4. Keep the WSP dry prior to adding to the spray tank.
|
||
5. Handle with dry gloves and according to the label instructions for PPE.
|
||
6. Keep WSP intact. Do not cut or puncture WSP.
|
||
7. Reseal the WSP outer packaging to protect any unused WSP(s).
|
||
|
||
Mixing Instructions
|
||
Follow the steps below when mixing this product, including if tank mixed with other pesticide products. If being
|
||
tank mixed, the mixing directions 1 through 9 below take precedence over the mixing directions of the other tank
|
||
mix products. WSPs may, in some cases, be mixed with other pesticide products so long as the directions for use of
|
||
all mixed products do not conflict. Do not tank mix this product with products that prohibit tank mixing or have
|
||
conflicting mixing directions.
|
||
1. If a basket or strainer is present in the tank hatch, remove prior to adding the WSP to the tank.
|
||
2. Fill tank with water to approximately one-third to one-half of the desired final volume of spray.
|
||
3. Stop adding water and stop any agitation.
|
||
4. Place intact/unopened WSP(s) into the tank.
|
||
5. Do not spray water from a hose or fill pipe to break or dissolve the WSP(s).
|
||
6. Start mechanical and recirculation agitation from the bottom of tank without using any overhead
|
||
recirculation, if possible. If overhead recirculation cannot be turned off, close the hatch before starting
|
||
agitation.
|
||
7. Dissolving the WSP(s) may take up to 5 minutes or longer, depending on water temperature, water
|
||
hardness and intensity of agitation.
|
||
8. Stop agitation before tank lid is opened.
|
||
9. Open the lid to the tank, exercising caution to avoid contact with dusts or spray mix, to verify that the
|
||
WSPs have fully dissolved and the contents have been thoroughly mixed into the solution.
|
||
10. Do not add other allowed products or complete filling the tank until the bags have fully dissolved and
|
||
pesticide is thoroughly mixed.
|
||
11. Once the WSP have fully dissolved and any other products have been added to the tank, resume filling the
|
||
tank with water to the desired level, close the tank lid, and resume agitation.
|
||
12. Use the spray solution when mixing is complete.
|
||
13. Maintain agitation of the diluted pesticide mix during transport and application.
|
||
14. It is unlawful to use any registered pesticide, including WSPs, in a manner inconsistent with its label.
|
||
|
||

PRODUCT INFORMATION
|
||
|
||
Orthene 75 S Soluble Powder is an insecticide for control of pests on selected agricultural crops and in certain non- crop
|
||
areas. The active ingredient in Orthene 75 S Soluble Powder is acephate, a water-soluble insecticide readily absorbed by
|
||
plant roots and foliage to give systemic control of feeding insects. Insect pests are generally controlled more effectively
|
||
by Orthene 75 S Soluble Powder through ingestion than by contact. Application of Orthene 75 S Soluble Powder to
|
||
maintain control should be repeated only as directed.
|
||
FAILURE TO FOLLOW THE DIRECTIONS FOR USE AND PRECAUTIONS ON THIS LABEL MAY RESULT IN
|
||
POOR INSECT CONTROL, CROP INJURY AND/OR ILLEGAL RESIDUES.
|
||
|
||
USE RESTRICTIONS
|
||
• For use on turf, use limited to sod farms and golf courses, except when applying to mound or spot treatment for fire
|
||
ant and harvester ant control.
|
||
• Do not apply with low pressure handwand except for control of fire ants as a mound treatment and when used on
|
||
ornamental trees, shrubs and floral plants grown for non-agricultural or non-commercial use.

• Not for indoor residential use. Not for use in residential greenhouses.

• For greenhouse use, use is limited to commercial greenhouses for use on ornamental plants, floral crops, ground

|
||
CHEMIGATION
|
||
|
||
Apply to cranberries only by sprinkler irrigation systems. Do not apply by chemigation to any other crop, or this
|
||
crop using any other type of irrigation system.
|
||
|
||
|
||
SPRAY DRIFT MANAGEMENT
|
||
A variety of factors including weather conditions, (e.g., wind direction, wind speed, temperature, relative humidity) and
|
||
method of application (e.g., ground, aerial, airblast, chemigation) can influence pesticide drift. The applicator and
|
||
grower must evaluate all factors and make appropriate adjustments when applying this product. Do not allow spray to
|
||
drift from the application site and contact people, structures people occupy at any time and the associated property,
|
||
parks and recreation areas, nontarget crops, aquatic and wetland areas, woodlands, pastures, rangelands or animals.
|
||
|
||
• All aerial, ground and air -assisted/airblast application equipment must be properly maintained and calibrated using
|
||
water as carrier. {This sentence to be used for products NOT containing “NON -CROP AREAS – Wasteland”:} [Do
|
||
not apply this product as an ultralow (ULV) spray, or in any carrier other than water]. { This sentence to be used for
|
||
products containing “NON-CROP AREAS - Wasteland:}[ Do not apply this product as an ultralow (ULV) spray, or
|

|
||
• Use the largest droplet size consistent with good pest control. Small droplets are more prone to spray drift and can
|
||
be minimized by appropriate nozzle selection, by orienting nozzles away from the air stream as much as possible,
|
||
and by avoiding excessive spray boom pressure.
|
||
• Do not apply at wind speeds greater than 10 mph at the application site.
|
||
• Make applications when wind velocity favors on-target product deposition (approximately 3 to 10 mph).
|
||
• Apply as close to target plants as practical to obtain a good spray pattern for adequate coverage.
|
||
• For aerial applications, do not apply at heights greater than 10 feet (consistent with flight safety).
|
||
• For airblast applications, direct spray above foliage and turn off outward pointing nozzles at row ends and outer
|
||
rows. Apply only when wind speed is 3 to 10 mph at the application site as measured by an anemometer outside of
|
||
the treated area on the upwind side.
|
||
• For aerial applications, the spray boom should be mounted on the aircraft so as to minimize drift caused by wing
|
||
tip vortices. The minimum practical boom length should be used and must not exceed 75% of wing span or rotor
|
||
diameter. The boom width must not exceed 75% of the wingspan or 90% of the rotary blade. Use upwind swath
|
||
displacement and apply only when wind speed is 3 to 10 mph as measured by an anemometer. Use medium or
|
||
coarser spray according to ASAE 572 definition for standard nozzles or VMD for spinning atomizer nozzles. If
|
||
application includes a no-spray zone, do not release spray at a height greater than 10 feet above the ground.
|
||
• For ground boom applications apply with nozzle height no more than 4 feet above the ground or crop canopy and
|
||
when wind speed is 10 mph or less at the application site as measured by an anemometer. Use medium or coarser
|
||
spray according to ASAE 572 definition for standard nozzles or VMD for spinning atomizer nozzles. The
|
||
applicator also must use all other measures necessary to control drift.
|
||

||
Resistance Management
|
||
|
||
For resistance management, ORTHENE 75 S Soluble Powder contains acephate, a Group 1 insecticide. Any insect
|
||
population may contain individuals naturally resistant to ORTHENE 75 S Soluble Powder and other Group 1
|
||
insecticides. The resistant individuals may dominate the insect population if this group of insecticides are used
|
||
repeatedly in the same locations. Appropriate resistance management strategies should be followed.
|
||
|
||
To delay insecticide resistance, take one or more of the following steps:
|
||
|
||
• Rotate the use of ORTHENE 75 S Soluble Powder or other Group 1 insecticides within the year with different
|
||
groups that control the same pests.
|
||
• Use tank mixtures with insecticides from a different group that are equally effective on the target pest when
|
||
such use is permitted. Do not rely on the same mixture repeatedly for the same pest population. Consider any
|
||
known cross -resistance issues (for the targeted pests) between the individual components of the mixture. In
|
||
addition, consider the following recommendations from the Insect resistance Action Committee (IRAC):
|
||
|
||
o Individual insecticides selected for use in mixtures should be highly effective and be applied at the
|
||
rates at which they are individually registered for use against the target species.
|
||
o Mixtures with components having the same IRAC mode of action classification are not recommended
|
||
for insect resistance management.
|
||
o When using mixtures, consider any known cross -resistance issues between the individual components
|
||
for the targeted pests.
|
||
o Mixtures become less effective if resistance is already developing to one or both active ingredients,
|
||
but they may still provide pest management benefits.
|
||
o The insect resistance management benefits of an insecticide mixture are greater if the two components
|
||
have similar periods of residual insecticidal activity. Mixtures of insecticides with unequal periods of
|
||
residual insecticide activity may offer an insect resistance management benefit only for the period
|
||
where both insecticides are active.
|
||
|
||
• Adopt an integrated insect management program for insecticide use that includes scouting, uses historical
|
||
information related to pesticide use record keeping, and which considers cultural, biological and other
|
||
chemical control practices.
|
||
• Monitor after application for unexpected target pest survival. If the level of survival suggests the presence of
|
||
resistance, consult with your local university specialist or certified pest control advisor.
|
||
• Contact your local extension specialist or pest control advisor for any additional pesticide resistance -
|
||
management and/or IPM recommendations for specific site and pest problems in your area.
|
||

Chemigation: Do not connect an irrigation system (including greenhouse systems) used for pesticide application to a public water system unless the label

prescribed safety devices for public water systems are in place.

||
A person knowledgeable of the chemigation system and responsible for its operation, or under the supervision of the responsib le person, shall shut the
|
||
system down and make necessary adjustments should the need arise.
|
||
|
||
The system must contain a functional check valve, vacuum relief valve, and low pressure drain appropriately located on the irrigation pipeline to prevent
|
||
water source contamination from backflow.
|
||
|
||
The pesticide injection pipeline must contain a functional, automatic, quick closing check valve to prevent the flow of fluid back toward the injection
|
||
pump.
|
||
|
||
The pesticide injection pipeline must also contain a functional, normally closed solenoid operated valve located on the intak e side of the injection pump
|
||
and connected to the system interlock to prevent fluid from being withdrawn from the supply tank when the irrigation system i s either automatically or

manually shut down.

|
||
The system must contain functional interlocking controls to automatically shut off the pesticide injection pump when the water pump motor stops.
|
||
|
||
The irrigation line or water pump must include a functional pressure switch, which will stop the water pump motor when the wa ter pressure decreases to
|
||
the point where pesticide distribution is adversely affected.
|
||
|
||
Systems must use a metering pump, such as a positive displacement injection pump (e.g., diaphragm pump) effectively designed and constructed of
|
||
materials that are compatible with pesticides and capable of being fitted with a system interlock.
|
||
|
||
Do not apply when wind speed favors drift beyond the area intended for treatment.
|
||
|
||
Solid Set System: Apply specified dosage for the entire length of the irrigation period or for a 30 to 60 minute period at the end of a regular irrigation set
|

or as a 30 to 60 minute injection as a separate application not associated with a regular irrigation. Allow time for all line s to flush the pesticide through
