On the basis of information furnished by the registrant, the above named pesticide is hereby
|
|
registered under the Federal Insecticide, Fungicide and Rodenticide Act. Registration is in no
|
|
way to be construed as an endorsement or recommendation of this product by the Agency. In
|
|
order to protect health and the environment, the Administrator, on his motion, may at any time
|
|
suspend or cancel the registration of a pesticide in accordance with the Act. The acceptance of
|
|
any name in connection with the registration of a product under this Act is not to be construed
|
|
as giving the registrant a right to exclusive use of the name or to its use if it has been covered by
|
|
others.
|
|
This product is unconditionally registered in accordance with FIFRA section 3(c)(5) provided
|
|
that you:
|
|
1. Submit and/or cite all data required for registration of your product under FIFRA section
|
|
3(c)(5) when the Agency requires all registrants of similar products to submit such data;
|
|
and submit acceptable responses required for reregistration of your product under
|
|
FIFRA section 4.

3. Submit one copy of the revised final printed label before the product is released for
|
|
shipment.

4. You must generate one year storage stability (830.6317) and corrosion characteristics
|
|
(830.6320) data on the proposed product. It is required that the observations be made at 0,
|
|
3, 6, 9, and 12 month intervals. The results must be submitted to the Agency in
|
|
electronic and hard copy format. Submit one year from date of this registration.
|
|
If these conditions are not complied with, the registration will be subject to cancellation
|
|
in accordance with FIFRA section 6(e). Your release for shipment of the product constitutes
|
|
acceptance of these conditions.

FIRST AID
|
|
IF IN EYES: Hold eye open and rinse slowly and gently with water for 15-20 minutes. Remove contact lenses, if present, after

the first 5 minutes, then continue rinsing. Call a poison control center or doctor for treatment advice.
|
|
IF SWALLOWED: Call a poison control center or doctor immediately for treatment advice. Have person sip a glass of water if
|
|
able to swallow. Do not induce vomiting unless told to by a poison control center or doctor. Do not give anything by mouth to an
|
|
unconscious person.
|
|
Have the product container or label with you when calling a poison control center or doctor or going for treatment. For medical
|
|
emergencies involving this product, call toll-free 1-800-441-3637.
|
|
PRECAUTIONARY STATEMENTS
|
|
HAZARDS TO HUMANS AND DOMESTIC ANIMALS
|
|
CAUTION
|
|
Causes moderate eye irritation. Avoid contact with eyes or clothing. May be harmful if swallowed. Wash thoroughly with soap and
|
|
water after handling and before eating, drinking, chewing gum, using tobacco or using the toilet.
|
|
PERSONAL PROTECTIVE EQUIPMENT (PPE)
|
|
Mixers, loaders, applicators, and other handlers must wear:
|
|
- Long-sleeved shirt
|
|
- Long pants
|
|
- Shoes and socks
|
|
Follow the manufacturer's instructions for cleaning/maintaining PPE. If no such instructions for washables are available, use
|
|
detergent and hot water. Keep and wash PPE separately from other laundry.
|
|
ENGINEERING CONTROL STATEMENTS
|
|
When handlers use closed systems, enclosed cabs, or aircraft in a manner that meets the requirements listed in the Worker Protec-
|
|
tion Standard (WPS) for agricultural pesticides [40 CFR 170.240(d)(4-6)j. the handler PPE requirements may be reduced or
|
|
modified as specified in the WPS.
|
|
|
|
USER SAFETY RECOMMENDATIONS
|
|
Users should wash hands before eating, drinking, chewing gum, using tobacco, or using the toilet. Users should remove
|
|
clothing/PPE immediately if pesticide gets inside. Then wash thoroughly and put on clean clothing. Users should remove
|
|
PPE immediately after handling this product. Wash the outside of gloves before removing. As soon as possible, wash thor-
|
|
oughly and change into clean clothing.
|
|
ENVIRONMENTAL HAZARDS
|
|
This pesticide is toxic to fish. Do not discharge effluent containing this product into lakes, streams, ponds, estuaries, oceans or
|
|
other waters unless in accordance with the requirements of a National Pollutant Discharge Elimination System (NPDES) permit
|
|
and the permitting authority has been notified in writing prior to discharge. Do not discharge effluent containing this product to
|
|
sewer systems without previously notifying the local sewage treatment plant authority. For guidance contact your State Water
|
|
Board or Regional Office of the EPA.
|
|

|
DIRECTIONS FOR USE
|
|
- It is a violation of federal law to use this product in a manner inconsistent with its labeling.
|
|
- Use this product only as a commercial seed treatment.
|
|
- Treated seed must not be used for or mixed with food or animal feed, or processed for oil.
|
|
- DuPont™ DPX-LEM17 250FS seed treatment must be used only in accordance with the directions for use on this label.
|
|
- Treating significantly damaged seed or seed that is low vigor or overall poor quality may result in reduced germination,
|
|
seedling vigor and plant stand. Before treating an entire seed lol with the proposed seed treatment, treat a small portion of
|
|
the seed lot and conduct subsequent germination tests. DuPont makes no guarantee regarding the germination of damaged
|
|
or carry-over treated seed, since seed quality and storage conditions are beyond the control of DuPont.
|
|
DPX-LEM17 250FS is a seed treatment fungicide which, when used as directed, provides protection against listed soil-borne
|
|
and seed-borne diseases of canola, com and soybeans. DPX-LEM17 250FS will protect against diseases caused by Rhitoc-
|
|
tonia solani, Fusarium, and Alternaria species. Use tank mixtures with other appropriate fungicides to control these diseases
|
|
or to otherwise extend the control spectrum (see Tank Mixing).
|
|
RESISTANCE MANAGEMENT
|
|
DPX-LEM17 250FS (penthiopyrad) is one of EPA's Target Site of Action Group 7 fungicides (carboxamides). A disease
|
|
management program that includes rotation and/or tank mixing with non-Group 7 fungicides is essential to reduce the risk of
|
|
fungicide resistance development.
|
|
APPLICATION AND MIXING GUIDANCE
|
|
Mixing Procedures
|
|
DPX-LEM17 250FS is for use in commercial seed treaters only, operating standard, calibrated seed treatment equipment.
|
|
This product is not for use on agricultural establishments in hopper-box, planter-box, slurry-box or other seed treatment
|
|
applications at or immediately before planting. Treatment equipment must be clean and free of previous pesticide deposits
|
|
before applying DPX-LEM17 250FS. Add DPX-LEM17 250FS directly to the mixing tank. Mix thoroughly the recom-
|
|
mended amount of DPX-LEM17 250FS with the required amount of water. If available on the application equipment, DPX-
|
|
LEM17 250FS can be applied directly through dedicated application modules.
|
|
Add an EPA approved dye or colorant to treat the seeds per 40 CFR 153.155(b)(l) during the seed treatment process. Ensure
|
|
that all treated seed are dyed an unnatural color.
|
|
Tank Mixing
|
|
DPX-LEM17 250FS seed treatment fungicide may be applied as a water-based slurry with other registered seed treatment
|
|
materials, such as fungicides, insecticides, or micronutrients, for the crop being treated. Potential mixing partners should be
|
|
tested for physical compatibility with DPX-LEM17 250FS and added dyes and polymers before mixing in a large tank for
|
|
seed treatment. Avoid mixing several materials in very concentrated spray slurries. Observe the most restrictive label limita-
|
|
tions and precautions of all products used in mixtures. Do not mix this product with any product that prohibits such mixing.
|
|
Mixing Tank Cleanout
|
|
Prior to application, start with clean, well maintained application equipment. Immediately following application, thoroughly
|
|
clean all mixing equipment to reduce the risk of forming hardened deposits, which might become difficult to remove.
|
|
Canola, Rapeseed
|
|
For protection against seed-borne and soil-borne Rhizoctonia, Fusarium spp., and Alternaria spp. that cause seed rot,
|
|
seedling blight, damping-off or blackleg, apply 1.23 - 3.07 fl oz per 100 Ib seed. The maximum use rate for DPX-LEM17
|
|
250FS as a seed treatment in canola is 0.064 ounces active ingredient per acre.
|
|
DuPont™ VERTISAN™ fungicide may be used in-season in canola for control of Alternaria blackspot and Sclerotinia stem
|
|
rot/white mold. When DPX-LEM17 250FS is used as a seed treatment for canola, make no more than two in-season foliar
|
|
applications of VERTISAN™. Do not apply more than 0.004 pound of active ingredient per acre (0.064 oz a.i./acre) when
|
|
|
|
used as a seed treatment. For example, if applying at 3.07 fl oz cwt seed, do not seed more than 8 Ibs of seed per acre. The
|
|
maximum use rate from seed treatment plus foliar treatments must not exceed 8.6 ounces of active ingredient per acre.
|
|
Field Corn, Seed Corn, Sweet Corn, Pop Corn
|
|
For protection against seed-borne or soil-borne Rhizoctonia and Fusarium spp. that cause seed rot, seedling blight, or
|
|
damping-off, apply 0.163 - 0.488 fl oz of DuPont™ DPX-LEM17 250FS per 80,000 kernel count of seed using the rate table
|
|
below as a guide. Use a lower rate when less disease pressure is expected, and a higher rate for more disease pressure. The
|
|
maximum use rate for DPX-LEM17 250FS as a seed treatment in com is 0.063 ounces active ingredient per acre.
|
|
DuPont™ VERTISAN™ may be used in-season in com for control of Anthracnose leal" blight, gray leaf spot, leal" spots,
|
|
northern corn leaf blight, northern corn leaf spot, rusts, southern corn leaf blight, and Physoderma brown spot. When DPX-
|
|
LEM17 250FS is used as a seed treatment for com, make no more than two in-season foliar applications of VERTISAN™.
|
|
Do not apply more than 0.004 pound of active ingredient per acre (0.063 oz a.i./acre) when used as a seed treatment. For
|
|
example, if applying at 0.488 fl oz/ 80,000 kernel count, do not seed more than 40,000 seeds per acre. The maximum use rate
|
|
from seed treatment plus foliar treatments must not exceed 10 ounces of active ingredient per acre.

|
|
guide. Use a lower rate when less disease pressure is expected, and a higher rate for more disease pressure. The maximum
|
|
use rate for DPX-LEM17 250FS as a seed treatment in soybean is 0.40 ounces active ingredient per acre. Do not use soybean
|
|
forage or hay for livestock feed.
|
|
VERTISAN™ may be used in-season in soybeans for control of Anthracnose, Alternaria leaf spot, brown Spot, Cercospora
|
|
blight and leaf spot, frogeyc leaf spot, pod and stem blight, rust, target spot, and Sclerotinia stem rot (white mold),. When
|
|
DPX-LEM17 250FS is used as a seed treatment for soybeans, make no more than two in-season foliar applications of
|
|
VERTISAN™. Do not apply more than 0.025 pound of active ingredient per acre (0.40 oz a.i./acre) when used as a seed
|
|
treatment. For example, if applying at 0.852 fl oz/ 140,000 seed count, do not seed more than 250,000 seeds per acre. The
|
|
maximum use rate from seed treatment plus foliar treatments must not exceed 12.7 ounces of active ingredient per acre.
|
|

COMMERCIAL SEED BAG LABELING
|
|
In accordance with the Federal Seed Act and EPA 40CFR, seeds commercially treated with a pesticide must be labeled as
|
|
follows:
|
|
"- Treated seed. Do not use for food, feed or oil purposes.
|
|
- This seed has been treated with DPX-LEM17 250FS seed treatment (penthiopyrad).
|
|
Treated seed exposed on soil surface may be hazardous to fish and aquatic invertebrates. Cover or collect seeds spilled
|
|
during loading.
|
|
- Store away from food or feed.
|
|
- Dispose of all excess treated seed by burying seed away from bodies of water.
|
|
Crop Rotation
|
|
The following list of crops and crop groups may be planted immediately after harvest:
|
|
Alfalfa, Brassica (cole) leafy vegetables crop group, bulb vegetables crop group (onion, garlic), cereal grains crop group
|
|
(barley, oats, rye. sorghum, wheat; except rice), corn (all types), cucurbit vegetables crop group (cucumber, melons, squash),
|
|
fruiting vegetables crop group (tomato, pepper), leafy vegetables crop group (lettuce, celery, spinach), legume vegetables
|
|
crop subgroup 6A (edible podded), legume vegetables crop subgroup 6B (succulent shelled), legume vegetables crop
|
|
subgroup 6C (dried shelled), low-growing berries crop subgroup (strawberries, lowbush blueberries), oilseed crop group
|
|
(canola, cotton, sunflower), peanuts, pome fruits, root vegetables crop subgroup (carrot, radish, turnip), soybean, stone fruits,
|
|
sugarbeet, tree nuts crop group (almond, filbert, pecan, pistachio), tuberous and corm vegetables and leaves crop subgroup
|
|
(potato).
|
|
All other crops cannot be planted until 120 days after the last application of DPX-LEM17 250FS seed treatment."
|
|
|
|
STORAGE AND DISPOSAL
|
|
Do not contaminate water, food, or feed by storage and disposal.
|
|
PESTICIDE STORAGE: Keep container closed when not in use. Always store pesticides in the original container
|
|
only, away from other pesticides, food, pet food, feed, seed, fertilizers, and veterinary supplies. If a leaky container
|
|
must be contained within another, mark the outer container to identify the contents. Storage areas must be locked and
|
|
secure from vandalism, with precautionary signs posted. The storage area must be dry, well-lit, and well- ventilated.
|
|
Keep pesticide storage areas clean. Clean, up any spills promptly. Protect pesticide containers from extreme heat and
|
|
cold. Store herbicides, insecticides and fungicides in separate areas within the storage unit. Place liquid formulations
|
|
on lower shelves and dry formulations above. Maintaining a spill kit and fire extinguisher on hand and having
|
|
emergency phone numbers posted will allow you to be prepared for emergencies. If spill cleanup PPE is stored nearby,
|
|
but outside the pesticide storage area, it will be accessible when needed.
|
|
PESTICIDE DISPOSAL: Wastes resulting from the use of this product must be disposed of on site or at an approved
|
|
waste disposal facility.
|
|
CONTAINER HANDLING:
|
|
Refer to the Net Contents section of this product's labeling for the applicable "Nonrefillable Container" or
|
|
"Refillable Container" designation.
|
|
Nonrefillable Rigid Plastic and Metal Containers (Capacity Equal to or Less Than 5 Gallons): Nonrefillable
|
|
container. Do not reuse or refill this container. Triple rinse container (or equivalent) promptly after emptying. Triple
|
|
rinse as follows: Empty the remaining contents into application equipment or a mix tank and drain for 10 seconds after
|
|
the flow begins to drip. Fill the container 1/4 full with water and recap. Shake for 10 seconds. Pour rinsate into applica-
|
|
tion equipment or a mix tank or store rinsate for later use or disposal. Drain for 10 seconds after the flow begins to drip.
|
|
Repeat this procedure two more times. Then, for Plastic Containers, offer for recycling if available or puncture and
|
|
dispose of in a sanitary landfill, or by incineration. Do not burn, unless allowed by state and local ordinances. For Metal
|
|
Containers, offer for recycling if available or reconditioning if appropriate, or puncture and dispose of in a sanitary
|
|
landfill, or by other procedures approved by state and local authorities.
|
|
Nonrefillable Rigid Plastic and Metal Containers (Capacity Greater Than 5 Gallons): Nonrefillable container. Do
|
|
not reuse or refill this container. Triple rinse container (or equivalent) promptly after emptying. Triple rinse as follows:
|
|
Empty the remaining contents into application equipment or a mix tank. Fill the container 1/4 full with water. Replace
|
|
and tighten closures. Tip container on its side and roll it back and forth, ensuring at least one complete revolution, for
|
|
30 seconds. Stand the container on its end and tip it back and forth several times. Turn the container over onto its other
|
|
end and tip it back and forth several times. Empty the rinsate into application equipment or a mix tank or store rinsate
|
|
for later use or disposal. Repeat this procedure two more times. Then, for Plastic Containers, offer for recycling if
|
|
available or puncture and dispose of in a sanitary landfill, or by incineration. Do not burn, unless allowed by state and
|
|
local ordinances. For Metal Containers, offer for recycling if available or reconditioning if appropriate, or puncture and
|
|
dispose of in a sanitary landfill, or by other procedures approved by state and local authorities.
|
|
Nonrefillable Rigid Plastic and Metal Containers, e.g., Intermediate Bulk Containers [TBC] (Size or Shape Too
|
|
Large to be Tipped, Rolled or Turned Upside Down): Nonrefillable container. Do not reuse or refill this container.
|
|
Clean container promptly after emptying the contents from this container into application equipment or mix tank and
|
|
before final disposal using the following pressure rinsing procedure. Insert a lance fitted with a suitable tank cleaning
|
|
nozzle into the container and ensure that the water spray thoroughly covers the top, bottom and all sides inside the
|
|
container. The nozzle manufacturer generally provides instructions for the appropriate spray pressure, spray duration
|
|
and/or spray volume. If the manufacturer's instructions are not available, pressure rinse the container for at least 60
|
|
seconds using a minimum pressure of 30 PSI with a minimum rinse volume of 10% of the container volume. Drain,
|
|
pour or pump rinsate into application equipment or rinsate collection system. Repeat this pressure rinsing procedure
|
|
two more times. Then, for Plastic Containers, offer for recycling if available or puncture and dispose of in a sanitary
|
|
landfill, or by incineration. For Metal Containers, offer for recycling if available or reconditioning if appropriate, or
|
|
puncture and dispose of in a sanitary landfill, or by other procedures approved by state and local authorities.
|
|
All Refillable Containers: Refillable container. Refilling Container: Refill this container with DuPont™ DPX-LEM17
|
|
250FS fungicide containing penthiopyrad only. Do not reuse this container for any other purpose. Cleaning before
|
|
refilling is the responsibility of the refiller. Prior to refilling, inspect carefully for damage such as cracks, punctures,
|
|
abrasions, worn out threads and closure devices. If damage is found, do not use container, contact DuPont at the
|
|
number below for instructions. Check for leaks after refilling and before transporting. If leaks are found, do not reuse or
|
|
transport container, contact DuPont at the number below for instructions.
|
|
Disposing of Container: Do not reuse this container for any other purpose other than refilling (see preceding). Cleaning
|
|
the container before final disposal is the responsibility of the person disposing of the container. To clean the container
|
|
before final disposal, use the following pressure rinsing procedure. Insert a lance fitted with a suitable tank cleaning
|
|
nozzle into the container and ensure that the water spray thoroughly covers the top, bottom and all sides inside the
|
|
container. The nozzle manufacturer generally provides instructions for the appropriate spray pressure, spray duration
|
|
and/or spray volume. If the manufacturer's instructions are not available, pressure rinse the container for at least 60
|
|
seconds using a minimum pressure of 30 PSI with a minimum rinse volume of 10% of the container volume. Drain,
|
|
pour or pump rinsate into application equipment or rinsate collection system. Repeat this pressure rinsing procedure
|
|
two more times. Then, for Plastic Containers, offer for recycling if available or puncture and dispose of in a sanitary
|
|
landfill, or by incineration. Do not bum, unless allowed by state and local ordinances. For Metal Containers, offer for
|
|
recycling if available or reconditioning if appropriate, or puncture and dispose of in a sanitary landfill, or by other
|
|
procedures approved by state and local authorities.
|
|
Do not transport if container is damaged or leaking. If the container is damaged, leaking or obsolete, or in the event of a
|
|

NOTICE: Read this Limitation of Warranty and Liability Before Buying or Using This Product. If the Terms Are Not

Acceptable, Return the Product at Once, Unopened, and the Purchase Price Will Be Refunded.

It is impossible to eliminate all risks associated with the use of this product. Such risks arise from weather conditions, soil

|
factors, off target movement, unconventional farming techniques, presence of other materials, the manner of use or applica-
|
|
tion, or other unknown factors, all of which are beyond the control of DuPont. These risks can cause: ineffectiveness of the
|
|
product, crop injury, or injury to non-target crops or plants. WHEN YOU BUY OR USE THIS PRODUCT, YOU AGREE

TO ACCEPT THESE RISKS.

DuPont warrants that this product conforms to the chemical description on the label thereof and is reasonably fit for the
|
|
purpose stated in the Directions for Use, subject to the inherent risks described above, when used in accordance with the
|
|
Directions for Use under normal conditions.

TO THE EXTENT CONSISTENT WITH APPLICABLE LAW, DUPONT MAKES NO OTHER EXPRESS OR

IMPLIED WARRANTY OF FITNESS OR OF MERCHANTABILITY OR ANY OTHER EXPRESS OR IMPLIED

WARRANTY. TO THE EXTENT CONSISTENT WITH APPLICABLE LAW, IN NO EVENT SHALL DUPONT OR

SELLER BE LIABLE FOR ANY INCIDENTAL. CONSEQUENTIAL OR SPECIAL DAMAGES RESULTING FROM

THE USE OR HANDLING OF THIS PRODUCT. BUYER'S OR USER'S BARGAINED-FOR EXPECTATION IS CROP

PROTECTION. TO THE EXTENT CONSISTENT WITH APPLICABLE LAW, THE EXCLUSIVE REMEDY OF THE

USER OR BUYER AND THE EXCLUSIVE LIABILITY OF DUPONT OR SELLER, FOR ANY AND ALL CLAIMS.

LOSSES. INJURIES OR DAMAGES (INCLUDING CLAIMS BASED ON BREACH OF WARRANTY OR

CONTRACT, NEGLIGENCE, TORT OR STRICT LIABILITY), WHETHER FROM FAILURE TO PERFORM OR

INJURY TO CROPS OR OTHER PLANTS. AND RESULTING FROM THE USE OR HANDLING OF THIS

PRODUCT. SHALL BE THE RETURN OF THE PURCHASE PRICE OF THE PRODUCT. OR AT THE ELECTION OF

|
DUPONT OR SELLER, THE REPLACEMENT OF THE PRODUCT.

To the extent consistent with applicable law that allows such requirement. DuPont or its Ag Retailer must have prompt
|
|
notice of any claim so that an immediate inspection of buyer's or user's growing crops can be made. Buyer and all users
|
|
shall promptly notify DuPont or a DuPont Ag Retailer of any claims, whether based on contract, negligence, strict liability,
|
|
other tort or otherwise, or be barred from any remedy.
|
|
This Limitation of Warranty and Liability may not be amended by any oral or written agreement.
