The Agency, in accordance with the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA),
|
||
as amended, has completed reviewing all the information submitted with your application to
|
||
support the Registration Review of the above referenced product in connection with the
|
||
Metalaxyl/Mefenoxam and Fludioxonil Interim Decisions, and has concluded that your
|
||
submission is acceptable. The label referred to above, submitted in connection with registration
|
||
under FIFRA, as amended, is acceptable.
|
||
|
||
Should you wish to add/retain a reference to the company’s website on your label, then please
|
||
be aware that the website becomes labeling under the Federal Insecticide, Fungicide, and
|
||
Rodenticide Act and is subject to review by the Agency. If the website is false or misleading, the
|
||
product would be misbranded and unlawful to sell or distribute under FIFRA section 12(a)(1)(E).
|
||
40 CFR 156.10(a)(5) list examples of statements EPA may consider false or misleading. In
|
||
addition, regardless of whether a website is referenced on your product’s label, claims made on
|
||
the website may not substantially differ from those claims approved through the registration
|
||
process. Therefore, should the Agency find or if it is brought to our attention that a website
|
||
contains false or misleading statements or claims substantially differing from the EPA approved
|
||
registration, the website will be referred to the EPA’s Office of Enforcement and Compliance
|
||
Assurance.
|
||
|
||
A stamped copy of your labeling is enclosed for your records. This labeling supersedes
|
||
all previously accepted labeling and must be used at your next label printing. You must
|
||
|
||

submit one copy of the final printed labeling before you release the product for
|
||
shipment with the new labeling. In accordance with 40 CFR 152.130(c), you may
|
||
distribute or sell this product under the previously approved labeling for 12 months
|
||
from the date of this letter. After 12 months, you may only distribute or sell this
|
||
product if it bears this new revised labeling or subsequently approved labeling. “To
|
||
distribute or sell” is defined under FIFRA section 2(gg) and its implementing regulation
|
||
at 40 CFR 152.3.

PRECAUTIONARY STATEMENTS
|
||
HAZARDS TO HUMANS AND DOMESTIC ANIMALS
|
||
CAUTION/PRECAUCIÓN
|
||
Harmful if swallowed. Wash thoroughly with soap and water after handling and before eating, drinking, chewing
|
||
gum, using tobacco or using the toilet.
|
||
PERSONAL PROTECTIVE EQUIPMENT (PPE)
|
||
Applicators and other handlers must wear:
|
||
x Long-sleeved shirt and long pants
|
||
x Shoes plus socks
|
||
Follow manufacturer’s instructions for cleaning/maintaining PPE. If no such instructions for washables exist, use
|
||
detergent and hot water. Keep and wash PPE separately from other laundry.
|
||
Engineering Controls Statement
|
||
When handlers use closed systems in a manner that meets the requirements listed in the Worker Protection
|
||
Standard (WPS) for agricultural pesticides [40 CFR 170.240(d)(4-6)], the handler PPE requirements may be
|
||
reduced or modified as specified in the WPS.
|
||
USER SAFETY RECOMMENDATIONS
|
||
Users Should:
|
||
x Wash hands before eating, drinking, chewing gum, using tobacco or using the toilet.
|
||
x Remove clothing immediately if pesticide gets inside. Then wash thoroughly and put on clean clothing.
|
||
x Remove PPE immediately after handling this product. Wash the outside of gloves before removing. As
|
||
soon as possible, wash thoroughly and change clothing.
|
||
ENVIRONMENTAL HAZARDS
|
||
This product is toxic to fish and aquatic invertebrates. For terrestrial use, DO NOT apply directly to water, to areas
|
||
where surface water is present, or to intertidal areas below the mean high water mark. DO NOT contaminate water
|
||
when disposing of equipment wash water or rinsate. Cover or incorporate spilled treated seeds.
|
||
Groundwater Advisory: Metalaxyl is known to leach through soil into groundwater under certain conditions as a
|
||
result of agricultural use. Use of this chemical where soils are permeable, particularly where the water table is
|
||
shallow, may result in groundwater contamination.
|
||
DIRECTIONS FOR USE
|
||
It is a violation of Federal law to use this product in a manner inconsistent with its labeling.
|
||
DO NOT apply this product in a way that will contact workers or other persons, either directly or through drift. Only
|
||
protected handlers may be in the area during application. For any requirements specific to your State or Tribe,
|
||
consult the agency responsible for pesticide regulation.
|
||
|

AGRICULTURAL USE REQUIREMENTS
|
||
Use this product only in accordance with its labeling and with the Worker Protection Standard, 40 CFR part 170.
|
||
This Standard contains requirements for the protection of agricultural workers on farms, forests, nurseries, and
|
||
greenhouses, and handlers of agricultural pesticides. It contains requirements for training, decontamination,
|
||
notification, and emergency assistance. It also contains specific instructions and exceptions pertaining to the
|
||
statements on this label about personal protective equipment (PPE) and restricted-entry interval. The
|
||
requirements in this box only apply to uses of this product that are covered by the Worker Protection Standard.
|
||
DO NOT enter or allow worker entry into treated areas during the restricted-entry interval (REI) of 48 hours.
|
||
Exception: If the seed is treated with the product and the treated seed is soil-injected or soil -incorporated, the
|
||
Worker Protection Standard, under certain circumstances, allows workers to enter the treated area if there will
|
||
be no contact with anything that has been treated. PPE required for early entry to treated areas that is permitted
|
||
under the Worker Protection Standard and that involves contact with anything that has been treated, such as
|
||
plants, soil, or water, is:
|
||
x Coveralls
|
||
x Shoes plus socks
|
||
x Chemical resistant gloves made of any waterproof material
|
||
PRODUCT INFORMATION
|
||
Dyna-Shield® FM is a seed treatment fungicide for use on soybeans, legumes, rice, and cotton to protect against
|
||
damping-off and seed rots due to Pythium, Phytophthora, Fusarium, Rhizoctonia spp., and Phytophthora root rot.
|
||
Dyna-Shield FM also suppresses seed-borne Sclerotinia and Phomopsis spp. particularly in soybeans.
|
||
Mix thoroughly before use or use entire container at one time.
|
||
Dyna-Shield FM contains an EPA approved dye/colorant that imparts an unnatural color to the seed.
|
||
Dyna-Shield FM is formulated for on-farm or commercial seed treatment.
|
||
Planter Box Treatment: Apply at the specified rate and premix with the seed directly in the planter box at planting.
|
||
Place half the amount of seed into the planter box and apply half the required amount of pesticide to the seed. Stir
|
||
the seed thoroughly with a paddle until the seed is uniformly coated. Place the remaining half of the seed into the
|
||
planter box and add the remaining half of the pesticide. Again, stir the seed with the paddle until all seed is
|
||
thoroughly coated.
|
||
Tank Mixing: All tank mixes should be pre-tested to determine physical compatibility between formulations. When
|
||
tank mixing, follow the most restrictive label instructions for any tank mix partner. DO NOT tank mix with any product
|
||
that bears a label prohibition against tank mixing. It is the pesticide user’s responsibility to ensure that all products
|
||
are registered for the intended use. Read and follow the applicable restrictions and limitations and directions for
|
||
use on all product labels involved in tank mixing. Users must follow the most restrictive directions for use and
|
||
precautionary statements of each product in the tank mixture.
|
||
MIXING INSTRUCTIONS FOR SOYBEANS
|
||
Dyna-Shield FM may be used with liquid rhizobia products that are resistant to fungicides; using standard
|
||
mechanical slurry or mist-type seed treatment equipment which accurately measures and mixes a flowable seed
|
||
treatment. The equipment must provide uniform coverage of Dyna-Shield FM on the seed. Uneven seed coverage
|
||
may not give the desired level of disease control. Dyna-Shield FM must be diluted with either water or liquid
|
||
inoculants prior to application to soybeans. Consult the manufacturer of the application equipment you plan to use
|
||
for suitability for this application and for instructions on operation and calibration of the equipment.
|
||
In a clean container large enough to contain the entire mixture add the desired amount of Dyna-Shield FM. Add half
|
||
of the required water or liquid inoculant and mix thoroughly. Add the remaining amount of water or liquid inoculant
|
||
and mix again. The slurry is ready for application to the soybeans. Mix as needed and do not store diluted mixture.
|
||
Additional or continuous agitation or mixing of the slurry mixture may be necessary to prevent the Dyna-Shield FM
|
||
from settling out of solution when using water or liquid inoculants. Dyna-Shield FM has been found to be compatible
|
||
with some liquid inoculant products. Dyna-Shield FM may be mixed or applied sequentially with approved liquid
|
||
|
||

inoculants. Consult the maker of the liquid inoculants and a Loveland Products, Inc. representative for directions
|
||
before applying Dyna-Shield FM with liquid inoculants.
|
||
Precaution: Dyna-Shield FM is specially formulated to be compatible with some liquid inoculants. If water is used
|
||
to further dilute Dyna-Shield FM when rhizobia are present, use only nonchlorinated water. Chlorinated water will
|
||
kill the live rhizobia contained in the inoculant.
|
||
MIXING INSTRUCTIONS FOR SEED AND POD VEGETABLES, RICE, AND COTTON
|
||
Apply Dyna-Shield FM as a water based slurry utilizing standard slurry seed treatment equipment which provides
|
||
uniform seed coverage. Uneven or incomplete seed coverage may not give the desired level of disease protection.
|
||
Thoroughly mix the labeled amount of Dyna-Shield FM into the required amount of water for the slurry treater and
|
||
dilution rate to be used.
|
||
Follow the manufacturer application instructions for the seed treatment equipment being used. Maintain constant
|
||
agitation of the slurry during the treatment. Allow seed to dry before bagging.
|
||

achieve proper total slurry volumes can be used.

The addition of an application of another approved metalaxyl or mefenoxam containing seed treatment product
|
||
may be used if targeting fields with high Phytophthora pressure. Users must follow the most restrictive directions
|
||
for use and precautionary statements of each product in the tank mixture.
|
||
|
||
|

SEED BAG LABELING REQUIREMENTS
|
||
Seed commercially treated with this product must be labeled in accordance with all applicable
|
||
requirements of the Federal Seed Act. The user of this product is responsible for ensuring that the seed
|
||
bag meets all requirements under the Federal Seed Act.
|
||
THE FEDERAL SEED ACT FEDERAL LAW REQUIRES THAT BAGS OF TREATED SEEDS SHALL BE LABELED
|
||
WITH THE FOLLOWING INFORMATION:
|
||
x This seed has been treated with (metalaxyl and fludioxonil) seed treatment.
|
||
x DO NOT use for food feed, or oil purposes. Store away from feeds and other foodstuffs.
|
||
|
||
U.S. ENVIRONMENTAL PROTECTION AGENCY REQUIRES THAT BAGS OF TREATED RICE SHALL BE
|
||
LABELED WITH THE FOLLOWING INFORMATION:
|
||
x “ Forage must not be grazed until 30 days after planting”
|
||
|
||
THE U.S. ENVIRONMENTAL PROTECTION AGENCY REQUIRES THE FOLLOWING STATEMENTS ON
|
||
CONTAINERS CONTAINING TREATED SEED:
|
||
x Store treated seed away from food and feedstuffs.
|
||
x Wear long pants, long-sleeved shirt, and protective gloves when handling treated seed.
|
||
x Cover or collect treated seeds spilled during loading and planting.
|
||
x Treated seed exposed on soil surface may be hazardous to wildlife.
|
||
x Dispose of all excess treated seed by burying seed away from bodies of water. DO NOT contaminate bodies
|
||
of water when disposing of planting equipment wash water.
|
||
x DO NOT contaminate water bodies when disposing of planting equipment wash water.
|
||
x DO NOT allow children, pets, or livestock to have access to treated seed.
|
||
x DO NOT graze or feed livestock on treated areas for 30 days after planting.
|
||
x Excess treated seed may be used for ethanol production only if (1) by-products are not used for livestock
|
||
feed and (2) no measurable residues remain in the ethanol by-products that are used in agronomic practice.
|
||
x Groundwater Advisory: Metalaxyl is known to leach through soil into groundwater under certain conditions
|
||
as a result of agricultural use. Use of the chemical where soils are permeable, particularly where the water
|
||
table is shallow, may result in groundwater contamination.
|
||
x After the seeds have been planted, do not enter or allow worker entry into treated areas during the
|
||
restricted-entry interval (REI) of 48 hours . Exception: If the treated seed is soil-injected or soil-
|
||

incorporated, the Worker Protection Standard, under certain circumstances, allows workers to enter the
|
||
treated area if there will be no contact with anything that has been treated. PPE required for early entry to
|
||
treated areas that is permitted under the Worker Protection Standard and that involves contact with anything
|
||
that has been treated, such as plants, soil or water is: coveralls, chemical-resistant gloves made of any
|
||
waterproof material, and chemical-resistant footwear.
|
||
|
||
STORAGE AND DISPOSAL
|
||
Do not contaminate water, food or feed by storage or disposal. Do not store near oxidizing agents.
|
||
PESTICIDE STORAGE: Store only in original container in locked storage areas. If a spill occurs, visible
|
||
puddles or drops should be covered with a dry absorbent such as clay, sawdust, lime or soda ash. Sweep up
|
||
and dispose of in a permitted disposal facility. Avoid cross-contamination with other pesticides and fertilizers
|
||
during handling and storage. Do not store near heat or open flame. Protect from temperatures below 0 degrees
|
||
F. Not for use or storage in or around the home.
|
||
PESTICIDE DISPOSAL: Wastes resulting from the use of this product may be disposed of on site or at an
|
||
approved waste disposal facility.
|
||
CONTAINER HANDLING: Nonrefillable container. Do not reuse this container to hold materials other than
|
||
pesticides or dilute pesticides (rinsate). After emptying and cleaning, it may be allowable to temporarily hold
|
||
rinsate or other pesticide-related materials in the container. Contact your state regulatory agency to determine
|
||
allowable practices in your state. Once cleaned, some agricultural plastic pesticide containers can be taken to a
|
||
container collection site or picked up for recycling. To find the nearest site, contact your chemical dealer or
|
||
manufacturer, or contact The Agricultural Container Recycling Council (ACRC) at www.agrecycling.org. If not
|
||
recycled, then puncture and dispose of in a sanitary landfill, or incineration, or if allowed by state and local
|
||
authorities, by burning. If burned, stay out of smoke. Triple rinse or pressure rinse container (or equivalent)
|
||
promptly after emptying.
|
||
For packages up to 5 gallons: Triple rinse as follows: Empty the remaining contents into application
|
||
equipment or a mix tank and drain for 10 seconds after the flow begins to drip. Fill the container ¼ full with
|
||
water and recap. Shake for 10 seconds. Pour rinsate into application equipment or a mix tank or store rinsate
|
||
for later use or disposal. Drain for 10 seconds after the flow begins to drip. Repeat this procedure two more
|
||
times. Pressure rinse as follows: Empty the remaining contents into application equipment or a mix tank and
|
||
continue to drain for 10 seconds after the flow begins to drip. Hold container upside down over application
|
||
equipment or mix tank or collect rinsate for later use or disposal. Insert pressure rinsing nozzle in the side of
|
||
the container, and rinse at about 40 PSI for at least 30 seconds. Drain for 10 seconds after the flow begins to
|
||
drip.
|
||
For packages greater than 5 gallons and less than 56 gallons: Triple rinse as follows: Empty the
|
||
remaining contents into application equipment or a mix tank. Fill the container ¼ full with water. Replace and
|
||
tighten closures. Tip container on its side and roll it back and forth, ensuring at least one complete revolution,
|
||
for 30 seconds. Stand the container on its end and tip it back and forth several times. Turn the container over
|
||
onto its other end and tip it back and forth several times. Empty the rinsate into application equipment or a mix
|
||
tank or store rinsate for later use or disposal. Repeat this procedure two more times. Pressure rinse as
|
||
follows: Empty the remaining contents into application equipment or a mix tank and continue to drain for 10
|
||
seconds after the flow begins to drip. Hold container upside down over application equipment or mix tank or
|
||

water. Agitate vigorously or recirculate water with the pump for 2 minutes. Pour or pump rinsate into application

||
equipment or rinsate collection system. Repeat this rinsing procedure two more times.

||
For refillable containers: Refill this container with pesticide only. Do not reuse this container for any other
|
||
purpose. Cleaning the container before final disposal is the responsibility of the person disposing of the
|
||
container.

product’s label, or use of this product contrary to the label instructions, all of which are beyond the control of

LOVELAND PRODUCTS, INC. and the seller. To the extent consistent with applicable law the buyer or user of this

product assumes all such inherent risks.

chemical description on the label and is reasonably fit for the purposes stated in the Directions for Use when the

product is used in strict accordance with such Directions for Use under normal conditions of use. EXCEPT AS

WARRANTED IN THIS LABEL AND TO THE EXTENT CONSISTENT WITH APPLICABLE LAW, THIS PRODUCT

IS SOLD “AS IS,” AND LOVELAND PRODUCTS, INC. MAKES NO OTHER WARRANTY, EXPRESS OR IMPLIED,
